Which is why I said it’s still rape.

You have over and over again said that she wanted to be with the 17 year old.

quote:

The evidence so far does show that she did like the 17yo so it’s not far fetched to think she wanted to have sex with a guy she liked.

At .319 she doesn’t know if she liked the guy hated the guy or if she wanted to have sex with the guy.

Even the part you bolded in your quote is clearly trying to absolve guilt by saying it’s rape “by law” but implying that it’s not really in the same level

You clearly either know one of the guys or have no decency.

We have the benefit of knowing her BAC level. That’s not something people know about each beforehand.

We were taught hands off if they appeared drunk 40 years ago, and its clear they knew she was drunk.

There is no excuse, period. They knew, they took advantage of her.

Sadly I think it’s the latter…

The bail business was flooded with morons who finance bail. Unlikely they put up the full $15,000 cash (and it's actually 12% of the bond amount with the fees). They may have put 3-5k down and financed the rest.

Washington lives in a house in Walker that's apparently not a family members. Or maybe it's momma's new man. So doubt they'll be putting up property (and it sold on Zillow in 2020 for $140,000 or so).

Bond on the first degree - if there is one at all - will keep Washington in there until trial.

believe the defendant has to waive the jury trial.

I'm pretty sure that is what my dad did...he had to go to court and request "A Trial By Judge." He ultimately took a plea deal.

New York Post has the story of the new rape charge up now:
quote:

Ron Haley, Washington’s lawyer, pointed at the timing of the witness stepping forward in a statement following his client’s arrest.

“Mr. Washington and his mother cooperated with the investigation two years ago, and law enforcement took no action,” Haley said. “Upon the review of the new statement from a witness that came forward yesterday, we are concerned not only of the timing of this statement, but whether it meets the threshold of probable cause.”

bullshite. Which is why we arrest and try people.

Shouldn't you be searching for young people dying? That seems to be your shtick.

It usually does, even if self fulfilling prophecies.

Our justice system fricking blows, no one really has faith anymore.

Daily Mail as well:

quote:

Prosecutor Stuart Theirort said at a hearing on Tuesday that the state would be seeking upgraded charges of first-degree rape and plan to convene a grand jury in the case.

At that hearing, the court heard that Washington filmed Brooks slurring her words  after the assault in the back of a car in the early hours of January 15.

Louisiana's first-degree rape statute carries a mandatory life sentence without the possibility of parole.

Low unless the family wants the public spectacle. The haven’t said a word publicly, so I doubt that.

And what would be your best guess time frame?

Very hard to say. The defense will be able to drag it some because they will need experts. It’s anybody’s guess. My WAG is that we are at least a year from trial in EBR.

At this point what can be put out there to the public that hasn’t already made it.

Easy for me to say but I think I’d go to trial if this were my daughter

Man idk. As the mother of 3 kids (30,25, almost 22) and youngest is a daughter, I’d of course want justice for my daughter but not sure I could mentally or emotionally handle any of it.

Prayed for her family in mass this afternoon. I truly can’t imagine.

But few would if the other kids (her siblings) begged them not to do so.

To be clear, I have no info whether she even had siblings. My point is that there are likely going to be those in the family who want no part of the story.

Nobody can.

Also, bad as being the victim’s family is, being the accused’s family is no picnic. Neither of them asked for this.

It’s easy to say “frick them for raising a monster,” but that’s a little too simple.

My point is this. Without in any way minimizing the unfathomable grief of the victim’s family, a lot of people get undeservingly hurt in this.
