The standard was is she incapable of understanding sex OR resisting (because of a stupor from an intoxicating agent). Her legs buckling and them catching her and walking her to the car as she is stumbling shows she was likely incapable of resisting and understanding. Three guys having to help her to the car is not evidence of her being able to resist or understand sex.
Also, they filmed her asking for consent like 20 times. That alone shows they knew she was incapable of consent but they were too stupid to think having a drunk girl nod or say yes on video would be enough to prove consent.

I did not think that’s what they filmed. Haley suggested that they filmed the aftermath in which she appeared very aware.

You are right. Reread the affidavit. Nothing in there about them filming that part.
Rereading the affidavit is helpful after a few days of the back and forth on here, things get fuzzy.
Casen kid says when she got in the car he asked for her address and she slumped over and could not respond. That’s when he drove to a parking lot and the two dudes in the back took turns with her.

Very doubtful any college girl gives consent to being anally abused in the back seat of a vehicle with 3 other onlookers. After that “encounter” getting hit by a car might have been better than living with what happened to her. He did not drive to a parking lot. He went to the first driveway on the left, directly across Nicholson, on Jennifer Jean. It gives the house's address in the affidavit.

She was stumbling, couldn't tell where to drop her off, couldnt consent and there are retarded people in this thread who still think the victim had some culpability in her own rape.

She did get plastered and asked stangers for a ride home. I'm not saying she deserved any of it, but not great decisions

How drunk was she at time of rape is the key question.
Video inside the bar showed she consumed no drinks for an hour before she left.
BAC at time of death was .319.
Did she consume any alcohol in the vehicle? If she did, that could be on the perps for getting her further intoxicated before dropping her off.
If she did not, size/weight/gender the interwebz say you lower BAC .016 per hour.
So if that is the case (and there are other factors always - what she ate etc.) then her BAC at the time of the rape was .335.
The Kiran page said the legal limit for someone 19 to drive is .02.
So she was 16x+ the legal limit. That was a good point made by a good journalist.

You are indeed implying that she deserved it. Had it been a dude asking for that ride, he may have been thrown out, but he wouldnt have been raped.

You do realize at .319 asking strangers for a ride home was not a “decision” at that point. She was black out drunk.
So, the only bad decision she made was getting black out drunk. Same decision every single person in college has made at least once if not multiple times.
She literally did the same thing that hundreds of thousands of college students do every weekend in the us. Weird that people judge her for this.

Yea, I never said it proves she wanted to have sex but you already knew that. I said it proves they didn’t target her to coerce her into the car.
No one knows what happened after that point and it’s speculation from anyone here discussing. Everyone is speculating. This is not hard.
