i'm aware of that. Are we not allowed to bring up the facts of this case when someone gives an obvious opinion that doesn't coincide with the facts?

Sure, it happens. But it's not relevant to this situation. People in this thread have been so hung up on "she would have never," "no one ever," "well what if" scenarios.
I didn't know this girl so I'm not going to pretend to know what she would or would not do. And it's not particularly relevant. I'm also not going to get hung up on the prevalence of group sex.
About the only thing that could sway me at this point would be if there was video evidence of her stone cold sober saying to these guys that she wanted to go out, get blasted, and then have sex with them in the car near comatose.
But we don't have that. Or anything close to it. What we do have is statements from two of the individuals involved stating that she was beyond drunk. That they offered her a ride home but she couldn't even remember where she lived. And that at least one of them had sex with her.
All this other stuff is bullshite.

Look I'm not into any of that, and i've only been with my wife, but i'm not naïve enough to believe that college aged girls don't have trains run on them, or sleep with random guys from the bar, or have the god forbidden interacial sex. It happens.
People have been hooking up in the back of cars after nights at the bar for a very long time.
and no that's not me saying she wasn't raped.

OT Lawyers please help: Will they get increased bail after they go to grand jury and get the 1st degree rape charge?
Also I know in 08 Kennedy v Louisiana overturned death penalty for first degree rape if no death of victim, would that be applicable here due to the unique circumstances? Vaguely remember everyone agreeing it was a bad decision so current court may overturn it
Seems like they would want them charged with 1st degree now to get bigger bail unless Hillar is doing grand jury in order to have everything sealed for death penalty.

Yes this is a capital crime. Supreme Court has a decision called Kennedy v Louisiana which overturned that if victim doesn’t die but this case may or may not fall under that. Likely long appeal if I had to guess

I was in this situation once in my early 20s.
Girl was hanging out with her friends at a bar I was at. We got to flirting and her friends decided to leave. I told them I would take her home.
She ended up getting pretty drunk pretty quick and when we left she couldn't tell me how to take her home. So I drove her to my place.
Got there, got her to call her friends number. Told them where she was and she could stay or they could come get her.
Put her in my bed and went to sleep on the couch.
Woke up with her naked on me. Dressed her in t-shirt and boxers and put her back in my bed. She immediately stripped again.
But I went back to the couch. Next morning, drove her home.
