That’s what I would do.
I would confirm with insurance company first though- they may even write a letter for you if you proved pics etc.bc they don’t want to have to cover it

yeah, i would tell the insurance company that "hey i know about this unhealthy tree over my roof that doesn't look great and i gots this neighbor with cancer that told me to frick off. I don't wanna do anything to protect my house but can you come over and have some hot tea with her and tell her to quit bullying me and trim the tree?"

I highly doubt that… I’ve never heard of rates going up bc of overgrown trees…

first of all, you never stated the condition of the tree? Is it healthy, but a limb covers your house?
As said, you can cut anything over your property line.
If tree is healthy, then she's not negligent.
If tree is dead, then she is negligent.

lots of companies in LA bc the market is such shite with companies have hard underwriting guidelines about tree limbs being so many feet away from house. Insurance companies absolutely have the legal ability to cancel a policy due to underwriting conditions of said house.

Louisiana Law:
Art. 688. Branches or roots of trees, bushes, or plants on neighboring property.
A landowner has the right to demand that the branches or roots of a neighbor's trees, bushes, or plants, that extend over or into his property be trimmed at the expense of the neighbor.
A landowner does not have this right if the roots or branches do not interfere with the enjoyment of his property.
Acts 1977, No. 514, §1.
I should point out that you need permission from the neighbor if you decide to cut it yourself.

In N.O., any branches that are on your side of a fence are your problem.
I had a neighbors 30 ft. pecan tree fall over during Katrina that was right on the property line between his house and mine. It not only fell over but also destroyed a good 30 ft. of my fence on the way down.
I broke out the chainsaw and got to cutting and had to use a dolly to move the rounds I had cut out of the trunk.
Also, when I was a kid one of our neighbors had 2 massive magnolia trees growing on the edge of their property and a lot of the branches hung over our yard. They dropped tons of leaves and those nasty cones damn near year round. Once I left home and it was just 3 females in the house, my mom got an uncle over with a chainsaw to cut the branches on our side of the property line. That made for a couple funny looking trees when he was done.

Just because the branches that fell are dry and dying, may not necessarily mean the actual tree is dead or dying. It also would not prove lack of maintenance. Also, your word from when they fell would not be sufficient to prove the tree is dying, you would need something from an arborist as well as proof that you provided her with proper notification.
