Dealing w neighbors over tree overhanging?

My neighbor has a beautiful old tree that’s likely a 100+ year old. Issue is during the last few windy days, one of the branch that touched my roof fell causing some alarms as it made a lot of noise.

I went over to ask the neighbor to cut it off but she told me she has cancer and can’t deal with this. She did look real rough and now I’m not sure. The laws are very blurry on who is responsible and I’m not sure I want to sue a 75+ year old cancer person but also don’t want to fork the money myself.

I believe it is actually your responsibility to cut the branch that endangers your property. It is also your responsibility not to sue an elderly cancer patient. Next

You are allowed to cut branches that overhang your property. If a branch falls out of a healthy tree it is considered an "Act of God"

I know, I get that she is sick but I’m not sure if that gives her a pass for not maintaining the property. It’s a tricky subject. I feel bad but I also know feelings don’t pay bills

But if I can prove it’s negligent maintained I can have them cut it. It’s clearly not properly maintained, the issue is what’s the gray area solution?


Also to add: she doesn’t want people going in her yard to cut.

in texas you can trim over your property line. Get a quote for trimming your side from a real arborist/tree trimming service, not jose's tree killing service. Tell her what you will pay, if she wants to do the rest she can pay them for it.

I think the whole cancer patient angle throws a curve ball into whether you do this part or not, but If the tree itself is a risk write a letter notifying her of the tree and send it via certified mail. Keep a copy on your computer. Take pictures of the tree. If it falls and hits your house her insurance will have to pay for the entire thing.

For the most part, anything hanging on your side of your property line you can cut. If the tree is dead on the neighbors side and it falls on your property and causes damage then they can be held liable but if a limb falls from a healthy tree and causes issues that could be considered an act of God.
Laws in different states can be tricky but for the most part that is what is common.

In La. one has the right to demand. From memory, there is no clear right to do the trimming yourself.

She’s 75 years old…. Do you live in the south? We don’t act like this down here. Cut the limb hanging on your property.

Thanks, this is my dilemma. I don’t think I should be the one bearing all the financial burden, but I also know she is sick and makes me feel bad.

FYI this tree is large large. I’m talking 50+ feet. Not something I have the tools for.
