Yep. You are expected to operate boats and other vehicles according to conditions. When you don’t and people die you can be charged.

Let’s say the highway speed is 70mph. You’re driving 60 mph, get into an accident and kill your passengers or people in another vehicle. Oops. Accident, right? Not if the roads are covered in ice. You are expected to lower your speed to match the conditions.

This isn't necessarily true. Owner does not mean captain, licensed or not. I used to "captain" a good friend's boat all the time, because he preferred to drive and let me handle the stressful parts. If I hit something, I would be personally liable.

Correct about the TN law forbidding jet skis after dark . Other boats with proper nav lights do have to be aware. Barges are on the water all hours and our rivers/lakes are a lot narrower than the Mississippi

I took the the Boater Safety Course and got the license/card/certificate/thing that almost side-tracked this thread. I got a discount on my boat insurance for taking it. I don't remember everything but I do remember that they were quite specific about what I wrote.

In some instances a boat is like a car. They are both operated by someone. The operator is responsible if their actions cause an accident or collision. The LEO isn’t ticketing the owner of a car if they’re in the backseat when an accident happens and someone else is behind the wheel. Same for a boat.

LEO will ask- who was operating the boat?

Correct. Boat owner will get the shite sued out of him regardless of who was operating but whoever was standing at the helm in charge of operating the boat will be criminally responsible for the accident.


That may be why they said the investigation will take weeks.

In point of fact, there are plenty of hypotheticals where the owner despite not being at the helm at the time of an accident could also see legitimate charges.

Have you ever piloted a fully loaded party barge? There is nothing nimble about one. From having a camp on the Tickfaw close to where this happened for many years, it’s almost a miracle there aren’t more of these. Overpowered boats, alcohol and testosterone are a dangerous combination, and the area where this happened has some very tricky hairpin curves.

After this wreck and that powerboat 100 yards in the woods last summer. I really have no desire to ever see the tickfaw river.

Same here brotha. Father's day weekend heading towards Lake Maurepas I almost got ran into the bank on Blind river cause some overloaded overpowered pontoon boat driver thought he was driving in the UK. He didn't even see me until his ole lady riding up.front got his attention. I haven't been on the river since

Plenty of times, many of the newer ones have 150+ hp they aren’t exactly floating barges anymore.

But what I meant, was that there’s no reason in the dark to pass anyone remotely close like during the day. I’m not familiar with that area so I don’t have a clue what happened.

I’m assuming they were going opposite ways on the river and the pontoon was tboned trying to avoid the boat? See idk? What I meant by take more evasive action is be absolutely no where close as soon as the boat was seen. As pointed out if this was around a corner in the river or somewhere with limited vis and the guy was going 50mph then I’ve been in that situation on a river in the daytime and it’s hard enough to avoid someone during daylight going that speed around a corner.

One week after a fatal boating accident in Tickfaw, two survivors of the crash are facing a long recovery.

According to a family friend, Hunter Caballero saved the life of his girlfriend, Jillian Bernard, when she was thrown from the boat and fractured her femur upon impact. Caballero sustained critical injuries himself, but still fought through the pain to save others.

"He saved her and was in the process of trying to save a few people and he struggled," said Tim Repp, a family friend of Caballero's.

Well there was a Captain on one of the boats.

The Hunter Caballero who is a captain in Venice is married with kids and there is nothing since the accident on his facebook that would indicate he was involved. I think it is a different HC
