You don't have to be driving; the cop established that she was in control of the vehicle because she was behind the wheel and the car was running when the cop arrived. She also admitted to driving from the bar to that location and planned to drive home after completing the conjugal visit.
I'm not a cop or an attorney but this based on my understanding of the law when local police department gave a safety briefing to our unit when I was in the army.

i have a coworker that got drunk, fell asleep in the drivers seat, but before he got in he tossed his keys under the car - was the only thing that saved him from a DWI - it got changed to Public Intox. cop said, but the rules, if he had the keys on him, it would have been DWI.

Something like this happened to me when I was a teenager. We were parked one night on a side road where people would park and watch airplanes take off and land making out and he came up on us.
We weren't doing the deed yet but she did have to scramble to get her sweater back on before he got to the car

In HS, my girl and I were parked at a marina, getting busy in the back seat. Cop rolled up. They made her get dressed and get out to ensure she wasn’t being raped, then they went on their way and she got back in and I had to find a new spot as the vibe was killed.
