Do you think your competition would answer his message at that time? Regardless of whether we like it or not, we are in a “what have you done for me lately” business climate.

Smartphones are the greatest thing to ever happen to salesmen.

Payphones and green bar paper will teach you to appreciate a text at 11 pm with the ability to get tracking in 25 seconds

Just because you are salary doesn't mean labor laws aren't in effect. Are you in a non-exempt position? If not you likely have a case. I am not sure how far you have to let things go though.

One of the subsidiaries of the company I work for got their asses handed to them in a suit like this. They were directly forcing an employee to work 16 hour days for almost a year before he got wise and stopped jumping when they said jump. So they started formal processes for firing (write-ups and eventually termination).

The man sued and won for wrongful termination and backed wages for the hours he was being pressed to work. The view was if you are expected to be on call 24/7 for an extended period of time (without a weekly rotation or something like that) then you should be paid accordingly.

Also, when you accepted employment was this aspect of the job explained to you?

It's particularly bad when you have clients emailing late at night with requests, and they're on the West Coast.

i do t know why but I view emails as less urgent than texts. I will check last emails around 5 my time and be done w em.

Because they absolutely are less urgent.

If I need something immediately, it's a call or a text, not an email. Not everyone has push notifications for email like they do for texts.

Depends on the position. Texting isn't common in my profession (or at least on my side of it).

I'd love to do that but it's just not feasible sometimes. I rarely deal with anything past 10PM or so, but I know a lot of people who have it a lot worse.

First things first. You don't give clients your personal phone number so they can do that crap. My wife works for a title company and is on the phone with clients for many hours a day, so she never gives out her home/cell number to anyone so they can bother her at home.

It galls me how some people think everything that happens in their lives is of the utmost importance and others should drop everything they are doing to help them.

Set an alarm to call them at 3am to confirm the tracking number then start trying to talk them into joining your Amway team or religion (both are similar approaches).

Unless you are specifically on call, 11:00 is unacceptable. Just answer them back the following morning.
