Come on man. These aren’t formal situations where I’m emailing or talking with HR people.
This would be casual conversations over drinks, on a golf course, or with a former manager, etc while at lunch. Good luck to some asshat trying to sue in a situation like that.

Maybe in a smaller market where jobs are tight they mean a lot.
Right now in this economy and in a large market, most companies want the talent no matter how it comes.

I hear that a lot... has it ever actually happened? How'd the suit turn out?
Kind of reminds me of those ads where they tiptoe awkwardly around saying "Super Bowl." When it comes to "some guy said this thing" lawsuits, "it's 100% true" is almost always an absolute defense.
