I negotiated a lease with a salesman at a Honda dealership in Lafayette. Through text he agreed to pay my remaining monthly payment of 253 if I got a new 3 year lease on a 2017 civic. I did the deal and the following week received a bill from Honda for that final payment of 253. I called the dealership and there position is that they didn’t agree to that....the salesman shouldn’t have offer that. It’s something they NEVER do. Now what? I’m not paying it, but I don’t want my credit screwed either. WWYD?

I'm no lawyer, but seems you have one of two options...

1) Salesman gets held to what he said he would do, regardless of what the dealership says, because of the text. Not sure a text would qualify as legally binding though.

2) Get it in writing next time.

That’s definitely a breach of contract if you have a text to prove that the agreement was made

Actual text:

We can do the 242 that JP said and we will absorb your last payment on our last 2017 in stock.

242+nothing down+absorb last payment? The white one in stock?

Yes sir!

The dealership should either A) not make you pay the last payment OR B) the salesman baw needs to pay it

As an upper management member of a pretty nice dealership, I say forward that text to the sales manager and/or GM or go up there. If they squabble over 250 bucks in the deal, they need to be reamed out on social media

That's kind of what I was thinking as well.

Still doesn't sound like he was supposed to get a bill for the $253 though.

Seems like you made an offer and it was accepted with a condition that you do a new 3 year lease. Pretty sure as a salesman he is authorized by the dealer to speak on their behalf... basically an agent.

Honestly this is something that needs to be dealt with in person. Get the manager and the sales guy and explain that you agreed to a 3 year lease based on them paying the remaining monthly payment. Do they want to cancel everything?

A lawyer will cost you more than the $253 just to write a letter. $253 for a 3 year lease is nothing for a dealer. Go sit down with them.

I'd probably pay it to avoid collections then fight dealership. I wouldn't put much effort into $250 though, just let them know I won't be doing business there anymore.

Better make sure you get something like this in the actual paperwork next time.

OT says leasing new cars is for suckers. Pay cash and drive for at least 400,000 miles.

Hmmm..

There are different standards of service and honesty at every dealership, economy and luxury. But there is no reason why, Honda or LR dealership, anyone should be fighting a customer over lease payment on a Civic. Somebody in management should whip out there overly fat wallet and put cash in the file. Thank the customer for choosing them over the other 6 Honda dealerships within 100 miles

To much room for communication error on phone or via text. Go in the damn dealership, put it on paper and get the managers Signiture and you won't have these problems
