No shite. How did his lawyer let that slip through

Let the lender have it. It's really only going to mess up his ability to buy a car for a while.
He's wasting his time if he catches it up for her. She'll just let it go delinquent again.
Cut your losses. Once the lender gets it, at least it won't be a reoccurring problem.

If it was settled in the divorce precedings and, on paper, a judge has signed off on the community property arrangement that she must pay the note, then if she's not paying it, she's in contempt.

Pretty much lol. And the dude she left him for drives a shitbox.
Thanks fellas, I'll relay the message and tell him it's probably best just to let it get repoed, be done with it and pay the difference. Sucks but st least he'll be rid of her for good.

It's in his name? Have it towed to an undisclosed location.

Hire a lawyer. A different one.

Cant squeeze blood from turnip. If car note in his name he is stuck. Contempt order not gonna satisfy auto lender. He should pay note and seek to modify child support with a credit for his paying. Judge may not go that far depending on means.

The deal was that she would pay for it
Good lord, what kind of shitty lawyer did your buddy have that thought it would be an acceptable settlement for the ex-wife to get to keep a car that was still being financed under ex-husband's name? Either the wife refinances the car under her name only, or they sell the car and split whatever proceeds were left after the loan balance is paid off.
As for now, how much does he pay in child support per month? How much is the car note? He needs to tell his ex-wife that if she isnt paying the car note, then he'll pay the note and deduct it from what he pays her in child support or she agrees to let him sell the car. If her agreeing to make the car payments was really part of the divorce agreement, then if she threatens to take him back to court over deducting car payment from child support, he can use her failure to comply with her part of the agreement to pay the car note.

Hire a new lawyer and explore a legal malpractice claim.

Get his buddy Al to pose as a banker and go take the car.
Bring back to his house.
Pay the note.
Keep the car.

Cant self modify child support order. Only judge can do that.
Posted on 12/22/16 at 9:20 pm to AlceeFortier
He'd still just be paying the child support, just in a different way. If anything, the threat of him taking it out of her child support might get her to start paying the note or agree to let him sell it
If she takes him back to court, they both end up in contempt so judge will end up warning both to comply with divorce decree or face stricter consequences in the future.

If he has the cash he can probably have the vehicle towed, take it back himself and get it caught up. If he can do that within a month the lender may agree to report his payments as being on time or in some way not affect his credit score. Then he can sell the vehicle and use it to pay the child support. Might be his one way to win-win here. Let the new guy provide a vehicle for her.

So a judge told her to pay for the car but the car loan was left in his name?
The car should have been disposed of at divorce time if she could not get a loan for it. Part of divorce is separating financially too.
Except for that support and alimony.
