If the old lady saw an accumulation of cans in that yard, it could be argued that the home owner was maintaining an attractive nuisance.

They neighborhood knew she was a collector of cans for recycling.

You'd have a completely different opinion if said person had bad intentions. Suppose someone was trying to break into your home "during the afternoon" while your wife and child are home alone? Dogs don't pick and choose. They protect their property....and so does yours. You better hope your dog is willing to kill in those circumstances. Your dog doesn't know the difference between mister bad man and the sudden appearance of scary 75 year old lady. A scared dog is going to protect itself and it's pack (your family.)

i don't rely upon my dog for my family's protection. It was not a "scared dog" that murdered this woman.

Woah... Even guard dog breeds are not intended to kill anyone. They are there to sound the alarm, detain if possible, and be menacing.

75 yr old woman didn't hop anything. she was acquiring cans that were being collected for her. UPS man, mail man, meter man, insurance inspectors... dogs don't have a free reign license to murder.

All I got out of that is that you're ok with your dog killing a child or harmless old lady just because it's "your property".
