Yes.

Looks like he's in the middle of the street in that picture and nowhere near the sidewalk
People move, you moron.

i don't think so either... personally, i think the agent that pulled the trigger was not the 1st officer, nor the one that shouted "gun, gun, gun", nor the one that carried his gun away from the situation after disarming him... it was one of the other 3 officers... one of the 7 did it
Which makes the legal analysis super complicated

It didn’t help that there couldn’t be any crime scene investigation due to the unsafe nature of the area once it happened. Local law enforcement couldn’t get there to protect evidence.

Barnes v. Felix:
Supreme Court struck down the "moment-of-threat" rule. Previously, some courts only looked at the exact second a shot was fired or a mask was worn.
The New Standard: Now, courts must look at the "totality of the circumstances" leading up to the event.

No, that's not my opinion at all.
ok, so what is your opinion on the matter then... my question was an opportunity for you to explain... so, again, i'm giving you an opportunity to explain it, as you see it

He was also not carrying his permit, which makes him unlawfully CCW'ing according to local statutes. So he essentially removed his legal authority by his own negligence.
i agree with this... but i do stand on the opinion that had the confrontation never happened, no one, including you and I, would have known Pretti was CCW that day, permit on him at the time or not...
quote:
Wrong for him to CCW AND confront law enforcement in the course of their duties
the "confrontation" came after the LEO pushed the lady... he wasn't there looking for a fight, but the LEOs definitely made sure a fight was brought to him...
it's a shame, all the way around... it really is... we have become so calloused that even something like this just gets boiled down to D vs. R...

In the video at the beginning, he is literally in the middle of the road directing traffic.
But that doesn’t mean he was actively impeding when he was maced.
It appears from the video that he retreated to the sidewalk for a substantial period of time before the first agent approached the woman.

Yeah, well such are the consequences when your state government adopts a policy of lawlessness.

quote:Thes low IQ protesters need to stay out of the streets then they wouldn't have to be pushed back like the lady and this guy. It is not their right to block the streets and try to prevent federal agents from doing their job. Get in their way and you can expect to get pushed out of their way. If the clowns in Minneapolis city and Minnesota state government would do their jobs none of this would be happening
and if the LEO doesn't push the woman, he's still alive

If tweet fails to load, click here. When does he move from the middle of the street?
Where are the 2 women with the blue on their heads?

He was in the street prior to this video. There is video of it.

So now being in the street doesnt matter.
You see how easy it is to prove how every talking point you bring up is dumb as shite? Stick to melting over your shitty fb program

Should be noted that I never expressed my stance on this subject. I’m just calling out the idiocy of what is being posted here.

Specifically not relevant to my question.
My question

Is that picture from the timeframe of the incident?
The answer is apparently "No"

Correct. It was the fact that he put himself between the officer and the woman that meant he was impeding. My comment was in reference to the other poster who said people move.

That it does, Edward. That it does, indeed.

Apparently it's not a "no" because you are intentionally being vague about timeframe. The sidewalk is in the background of that photo.
I was responding to your other post about how he was in the street more, even before that photo
