In fact, if I was a betting man, I would bet that you’ve never heard of them until five minutes ago.

And you would lose.

It is going to depend on what the shooting officer knew at the time he pulled the trigger. Give the timeframe and movements, I seriously doubt that the shooting agent knew that Pretti has been disarmed 1-2 seconds before. The biggest question is going to be who the first shot came from and what was being communicated between the officers in this crucial 3-4 seconds.

Yeahhh seems like you’re comparing apples to orange juice here

You don’t get to escalate a situation to such an insane degree and then hide behind the confusion you created when your fellow officer disarmed a man and you shot him in the BACK while he was on the ground.

That totality of circumstances dog won’t hunt and will probably actually hurt.

But I doubt this ever goes to any real legal place since we know who is pulling those strings. They aren’t exactly a forthright beacon of truth and justice

so what is your opinion on the matter then

It's a personal choice, a very obvious explanation as the very act of CCW at any level is a personal choice.

quote:

but i do stand on the opinion that had the confrontation never happened, no one, including you and I, would have known Pretti was CCW that day, permit on him at the time or not...

Then he should have stayed away from that area, he chose to actively participate in that situation. Confrontation wouldn't have happened if he had been considerate of the fact he was carrying a weapon while putting himself into a volatile situation with law enforcement.

quote:

the "confrontation" came after the LEO pushed the lady... he wasn't there looking for a fight, but the LEOs definitely made sure a fight was brought to him...

Was he the lady that was shoved? No. Obviously it was not a situation that required him riding in to white knight for her but he chose to do so anyway, while armed. Bad decision on his part.

Life is nothing but choices and consequences. I carry a gun pretty much everywhere I am legally able to. For some people, they carry with the mindset to avoid confrontation as they know the consequences of escalation. For others, they carry with the intent it will shield them if they escalate the situation. Pretty obvious to see what mindset Pretti was in.

But that doesn’t mean he was actively impeding when he was maced.

It appears from the video that he retreated to the sidewalk for a substantial period of time before the first agent approached the woman.

exactly... at the time of the confrontation, he was on the sidewalk, with phone in hand, gun concealed... there was no perceivable threat to anyone, at that time, regardless of him playing crossing guard earlier

What kind of lawyer are you? Because a court/judge would determine that the “start” of the incident would be his or other’s actions that lead to the result which starts with him in the road. A court would allow his actions in the road to be a part of the whole story/discussion and possibly even the justification for force.

Apparently it's not a "no" because you are intentionally being vague about timeframe

No he responded to this

there is not one video, of all the videos out there, that show Pretti as the one that escalated the situation... not one

Discussing LEO starting this by pushing the woman. That's the relevant timeframe.

Why would something that happened in the street minutes prior have any bearing on the shoot or the escalation that led to the shoot?

Perceived threat does not require gun in hand.

That is a good timeline. It makes me think the first agent may have thought the dead guy was the one unholstering the gun.

At the time of his interfering in the street, he can be identified as someone who could require extra attention. It’s a reasonable assertion by an officer to notice him being obstructive and recall that for later.

Was she on the sidewalk the entire time?? Was the dead idiot also contained to the sidewalk?? Do you have video of these "facts" or could they have been impeding the ICE operations previously?? I saw shot guy move to middle of street and attempt to direct traffic prior to being shot. I guess they just remained statically on the sidewalk because that's where they were when this all escalated. These morons are purposely putting themselves in harm's way by trying to disrupt these operations and neither you nor I know what these idiots were doing into the lead up to the shooting.

That’s nothing new for him and I truly dislike it because it’s just fodder for people to lose their minds over.

Probably not. Not if we were talking about a prosecution of the officer who killed him, at least.

It's not relevant at all and potentially prejudicial to the facts that matter.

It would start with the push.

There is a very real possibility that the shooting agent is found to be justified in his use of force but ICE, as employer, is held civilly liable for the actions of agent one and the consequences of his actions.

There is also the potential state charge, which would be fun.

I am not sure if the admin permits his identity to be released to the state, which is a battle I'm waiting to watch unfold.

Much earlier, she was on the other side of the street interacting with an officer while they detained someone.
