Think felony hit and run is up to ten. But even if he gets ten, he may serve like two.

He should be charged with negligent homicide at minimum
Seems hard to say that definitively right now

See another problem with this is. They took Jude’s blood samples and if he was drunk then they are pretty much screwed.. didn't use a cross walk and was drunk. Kid will walk free in that case besides probation for the hit and run possibly.

People need to think of the donte stallworth incident

He killed a man crossing a highway. He was over the legal limit, but ultimately the majority of the blame was on the deceased as even a stone cold sober person couldn’t have avoided the accident.

Now, stallworth stopped and immediately rendered aid so the shitty aftermath decision making was far different

I would argue Brister was negligent/careless operation in speeding around the car in front of him, which the driver of that car that flashed Jude across stated. He also fled the scene so I would imagine that goes into the calculation but a criminal lawyer should weigh in.

Wait what?? That’s a reach … Negligent homicide or vehicular homicide not the charge here… yeah fleeing the scene look bad … but it happens

Not sure exactly the Florida statute but in Louisiana, you commit vehicular homicide if you hit and kill someone with a BAC over .08 whether you intended it or not. Fault doesn't matter on the part of the deceased.

If they can prove the driver was speeding then that changes a lot as well

No doubt. We were talking about it last night. If he stops, he prolly gets hit with a DWI & that’s it. That’s what happened in the Dante Stallworth case. Kinda comparable I guess. The lane he switched to was a second turn lane right? He didn’t swerve into the oncoming lane to go around.
But the running and hiding out til he’s ready? bullshite
