1099 just means your an independent contractor. Assuming your employer isn't just trying to skip out on taxes then you set your own schedule, you choose the work you want to do, you use your own tools, etc.

Uber is a pretty big 1099 example, they contract out your time and your car, and in turn they keep part of the money you earn for the use of their system.

you can lien his property if you have a written contract
assuming you do it only costs a few bucks to do so

if you don't it's on you to collect and/or decide whether it's worth your trouble
if it was me and an 80 year old man couldn't afford to pay me my 300 bucks I'd just move on

@Cgrand, I don't have an actual contract, but I have paperwork where I did complete the work. So not sure if I have what would be needed to put a lien. The dude live in, albeit a nice/new one, but a trailer none the less in diamondhead MS.


I'm just going to text him once a twice a week and tell him he should be ashamed. I'll get a friend to send him a letter with an official attorney letter head on it... he may pay me, he may not... if he doesn't, I'll also contact the job center and let them know that he hires crews through them and that he doesn't pay contracts.

I've already wrote the money off, so the $300 would be a nice little come up on some pocket change. A good meal and weekend fricking off.

You'd have to take him (his business if you worked for his business) to small claims court, which you will have to pay a good bit upfront. The old man won't show for court; you will win default judgment. Then the sheriff's office will send someone to talk to him. They'll have trouble finding him, and when they find him, he will claim to be bankrupt. They will assume he is telling the truth. If they get around to it, they will have to confiscate an asset that is in his name or business. If he owes you the money personally, you are almost guaranteed not to get it if he doesn't want to pay it.

He probably has all of his assets owned by a company, which makes it extremely difficult to confiscate legally.

If the sheriff's dept doesn't get your money, then you will also be out the cost of court. You are better off letting it go except for continuing to nag him.

It's a 1st party debt. You can do almost anything you want to do to collect it, you are not bound by 3rd party collection limits.

You can drive up to his residence with a car labeled "Debt Collector" and post signs on telephone poles all around his neighborhood with his picture, name, and address, and the amount owed. You can call his friends and neighbors and talk openly and freely about his business dealings and what a 2 timing scumbag he is that owes you money. You can get a lawn chair and sit in front his house with a Mister Microphone and call out to him: "Hey Deadbeat, why don't you pay me what you owe me?"

Get as down and dirty as you like. He owes you directly, no limits outside of assault and battery.

Seriously though, determine what your time is worth. If you want to be your own collector and call him daily, go for it. Eventually it will cost you more time and frustration than $300 is worth.

Write a letter on some fake attorney letterhead with a date to pay by.

Threaten to sue him. Get a lawyer friend to write him a letter. Don't sue him. It's not worth your time. Small claims court is a major PITA.

I'd also call the employment agency and tell them what's going on. They probably won't care, but you did your part
