Baton Rouge officers involved in Alton Sterling case have appeal hearings granted

Salamoni's hearing, the officer terminated for his conduct in the incident which included firing the shots that killed Sterling, will be held Oct. 18 and 19, the Municipal Fire and Police Civil Service Board decided Thursday. The hearing for Lake, who was suspended for three days for his conduct in the incident, will be Nov. 15.
Both hearings will come more than two years after the encounter outside a convenience store on North Foster Drive in July 2016, which drew days of protests nationwide about police brutality.
Lawyers for Salamoni, Lake and Baton Rouge Police Chief Murphy Paul agreed on the dates and the decision to separate the hearings.
"We definitely want a decision, but we don't want to be rushed," said Salamoni's lawyer, John McLindon. McLindon said since Salamoni's firing he has gotten a job, but would not say where the former officer found employment.

The board agreed the dates for the hearings were appropriate to give time to attorney's to file subpoenas and prepare evidence exhibits for the board.

They have a right to file an appeal. So saying they were granted an appeal makes it appear that it is discretionary.

No one will hire him. Doesn’t mean he deserves to be improperly fired.
SWB wanted these two cops punished regardless of the outcome of the investigation. And I seriously doubt they followed all the procedures necessary to fire one and suspend the other for what would be considered a clean shoot.

The main criteria for the prior chief resigning and the new chief being hired were “Fire Salamoni and Blake.”
If nothing else, that shows prejudgment and I have a very good suspicion that neither the chief nor SWB went through all the protocol required to fire a cop in this city.
It’s like state employee firings. It can be done but a blatant disregard for procedure involved gets the firing tossed and the state paying a settlement, reinstating the employee, or both.

Salamoni isn't looking for a payday, he is looking to get the termination off of his record.
If he wins the appeal he will able to resign from BRPD & work for another department.

Gotcha. I'd imagine that will still be an uphill battle given the criticism he received from the use of force experts, but I guess we'll see.

LoL. Yeah, the hand-picked experts from the US DOJ that couldn't even agree. Go back and read each of their full reviews. One guy said that Salamoni tackling Sterling was the worst thing he had ever seen in law enforcement. The other guy said it was a fantastic maneuver that was the proper thing to do.
