Mr Miyagi was a prick but the other dude was the only person threatening. The arrest is completely unconstitutional.

Ng's speech fits within the Arizona DC statute the reaction of the black man actually strengthens the case. If someone wants to contest it on constitutional grounds they could but would likely lose.

What do I mean?

Democrats' mindset = Throw white supremacy groups in jail

"because there is no longer room for that in our country"

versus

A Trump country, or his supporters are the voices who believe:

"I don't agree with the racial slurs, but they have they right to believe and say what they want in our free country"


Thus the consequences shouldn't be jail...for free speech.

meanwhile we have white punks in Seattle and Portland spitting and calling police the N word, (even black police men and women) pig, die, racist and the rest of their BS...and nothing happens to them.

I think most people would agree there should be a legal limit to this. Now if you do agree this is beyond the scope of the protection of FOS when there is a line between what NG did and this hypo.


I do think there should be a limit to harassment like that described in the hypo, and I do think there is a line somewhere between that hypo and what Ng did.

It was the other guy who threatened physical violence and, actually, both said the n-word.

Ng may be an awful person, but that's not against the law. He should not have been arrested.

I was in a local store recently where there was rap music playing. Every other word was Effin N. No joke. I made my kid go back to the car while I purchased what I needed.

Should the guy running the store be arrested? No.

What should I do as a citizen? Answer: Not go back there. Period. Simple as that.

Then again, I'm not a Progressive.

That was the point. Most people will think there is a line. The DC statutes in most jurisdictions would allow him to be charged without even a sniff of a 1983 action as some have postulated. My point is there is a legitimate reason (in at least many people's minds) for the AZ and LA DC laws to be written as they are. If the prosecutor doesn't use his description and goes forward and Ng is found guilty he could appeal.

The way the AZ law is written the black guy's threats strengthen the case against Ng not weaken it.

That hypo has very little is anything to do with the current case. It isn't the use of the word it is the circumstances surrounding the use of the word. Read the AZ statute I posted earlier.

If a stranger walks up to your kids or wife and starts hurling insults at them (without physically touching them), that's not protected speech. You would reasonably want to kick his arse.
