Anyone have experience with Drug Related Class Action Lawsuit? Drug is Invokana

The type 2 diabetic oral medication(Invokana) I was taking for about 18 months during the last 6 months I have come to find after three hospital stays produces very uncomfortable and dangerous side effects that the company neglected to warn about and let the drug come on the market too early even with FDA approval......it appears they didn't fully reveal all the researched test results.

There are class action lawsuits about this drug and was wondering if I'd be better off having a individual suit or joining the class action? I do know in the class action every one is an individual suit, they are just lumped together. I wonder if an individual attorney representing me would be a better option? I'm not trying to get rich of this.....would like my substantial medical bills paid and some compensation for time off from work, etc.

Never been involved in anything like this so looking for some input TIA

You need to go see a real lawyer. You have no idea, based on your post, of how this works.

So, how exactly did you come to find out that your medical issues were due to the medication if those specific side effects have not been reported? It sounds to me like your side effects have indeed been reported, but you may have been unaware of these potential side effects.

You'd have to know if you meet the class definitions. Then there is a whole bunch of stuff you will need a lawyer to figure out for you.

Your medical bills and payment for lost work won't be covered in the class action. A class action is presicly to avoid numerous individual trials and individual damage awards. Go it alone if you want your own damages but you'll be paying fees unless you get a contingency and expect you trial to be on hold until the class action is resolved as the putative defendants aren't going to let some wise arse in state court get a judgment first.

Get a consult with a reputable attorney in your state. He/she can send you in the proper direction.

Here's best explanation I can find......I started using in March of 2014. In October this year after my 3rd episode a Dr in hospital gave me his opinion. Immediately after not taking and until now I've had no episodes of any of the symptoms including DKA

Been told a couple of times there were class actions for the drug and that it sounds like I should qualify. Just looking for some thoughts

I think in a class action people with more problems get a higher award

My grandma and aunt were in one against phen-fen. They had an ekg and got $100k each

Severe diabetic ketoacidosis which hurts like hell.....started with morphine, then fentanyl, dilaudid and lastly oxycodone

It suxed last time after getting out of hospital after 4 days I didn't leave the house except to go to doctor for 13 days.

I just assumed most of these were fishing attempts to catch people with a warrant out...
