You aren't getting CONVICTED IN COURT from one beer. They will charge you all day long and the local paper will run the arrest report the following morning. Then that police report will be your number 1 google result forever.
I don't know a single person in my entire life that this has happened to. You take the sobriety test and maybe they make you blow in a tube. You blow a .02 and they write you a ticket for an open container.

Not in St. Tammany.

I do the opposite. I have a few every morning while on my way to drive the school bus.

I got pulled over and blew under the limit. The officer took me in, and I spent the night in jail anyway, ended up on the county mugshot website, had to borrow money for an attorney since I was in college, and had to keep a blow-and-go in my car for 6 months while waiting for the charge to get dropped (it eventually did).
So this does check out. Do not recommend. It wasn't just one beer, but all they have to do is suspect you are under the influence of something in addition to the drink to take you in.

Yeah, I don't think
one roadie leads to arrest.

You think these ole boys in this thread that are drinking tallboys or stopping at the local dive are going to blow a .02? You think they should blow?

You think they should submit to field sobriety testing? You think that's being done for your benefit?

If you buy a 24 oz beer and are sipping on it on the way home from work and get pulled over in the process you aren't blowing a .08 unless you are 60lbs

I love how everyone assumes this. I spent the night in the drunk tank because I had an empty beer can and I wasn't even driving.

If you ever wondered what kind of idiots spent time posting on the OT... Now we know.

I have been pulled over with a road beer once or twice. I don't really even do it anymore but that wasn't always my policy. Nothing happened. I've never heard of anyone going to jail over an open container. Otherwise cops in South LA could just arrest everyone leaving a daiquiri shop

So now that you've had at least 3 people speaking from experience telling you that your assumptions are wrong, you still wanna talk about the way you have it figured?

They can and do in Kenner. I was in the back seat with an empty beer can I forgot to throw away when we left one party and I didn't want to toss it in front of my buddies house so I hung on to it to pitch when we got to the next house and it got me 6 hours in lockup. They called in crime scene to take picture of the can, finger printed it and everything.

I used to occasionally. At least half the guys at the plant did this. There was a conversation in the control room about the open container law when it was first passed. The consensus was "I don't like littering but that can is going out the window when I'm done".

What's the difference between having a drink at the end of the work day before you head home vs having one on the way home? (Outside of one being illegal, I don't see much of a difference.)

Only when spotlighting on remote WMA roads.

I used to work with a guy who kept an ice chest in the back of his truck with his week worth of "roadies" iced down. He'd have a couple on the way home each day.
One day I checked in the cooler to see what he was drinking and went out and bought a case of the same beer. Every day for a couple of weeks, I would add 2 or 3 cans to his cooler without his knowing.
At the end of the 2 weeks, I began removing 2 or 3 cans from the chest each day.
Just to mess with him.
