Do you not usually read the article before making ridiculous statements? The man was woken up to someone trying to gain entry into his home via the front door... that's strike one. Then he goes to investigate and sees the male in his garage/shop and tells him to leave and he doesn't comply, that's strike two. Then the homeowner fires a warning shot as the subject is approaching him; the subject continues to approach AFTER being fired at, that's strike three. You're out...

So in that situation in the middle of the night with a larger than normal man acting in the manner he was, you wouldn't feel threatened?

Criminally he's likely justified but if he doesn't have a damn good civil attorney he's fooked.

If he’s in his house and this happened ok but if the kid is just in his yard I think the homeowner is gonna pay.

You think it was the right decision to go out there to confront him?

For the record, I’m not participating in this thread on the side of anyone who hopes the homeowner faces penalties for his actions. I don’t know whether it was justified, but I suspect a jury would side with the homeowner feeling threatened if the young man was in the garage/shop and still trying to get into the home.

Doesn't matter where he was. If he can prove he reasonably felt his life was in danger you are justified in Louisiana to defend yourself with deadly force. No duty to retreat. His criminal case while not a lock will be much easier than the civil case that's sure to come.He can be found innocent in criminal court and lose everything he has and ever will have in civil court.

But I'm just speaking roundabout, I really don't know anything about the case.

Not sure I'd go that far, but it seems like he didn't do anything wrong based on what has been presented. Not sure of the legality of a warning shot, but to me it's clear the guy didn't want to kill the kid.

I wonder if the video will show that the warning shot is what ultimately triggered an aggressive response in the kid rather than a retreat. Would be the height of stupidity, but I could see that being possible if he was feeling 10 feet tall and bullet proof (oof) as drunk people do.

I would respectfully suggest that it takes more backbone not to shoot someone (e.g. the Asian family who helped out the drunk kid passed out in their kitchen). Refraining from shooting is generally going to be the more courageous act.

Someone’s agenda is showing.

There’s video evidence of what happened, large kid (who advanced despite warning shot on homeowner), and had been trying to make entry into the house. Twice. Not “walk on property” as you had disingenuously said.

And this is not a “black kid was up to no good” post from me. I have a child who was friends with him. I belonged years ago to the same fraternity. By all accounts, he was a good kid, definitely not the type you hear of in these “racial” situations.

Just a horrible, shitty ordeal for everyone involved.

A good dog resolves a lot of these situations.

My outside dog will sound off if someone is coming up to the house. The indoor dog won't let anyone inside unless I give her the command to stand down (and she also has an engagement command if I need her to get after someone).

I realize that in town you won't have an outside dog.
