We're number 1 in per capita as well... outpacing our closest competitor by almost 20%.

War on drugs, for profit prisons, mandatory sentencing, cash bail for low level crimes, etc.

War on drugs made mandatory minimum sentences for certain crimes, 3 strikes you’re out rule are two big issues.
You’re right, people aren’t arrested usually for doing drugs peacefully in their homes, it’s the violence associated with dueling black market ownership

Seems like a better metric would be incarceration-justifying-crime per capita, however you choose to then define that.

Look can we all clear something up here.
"Tax the shite out of it" is a means to an end. No one really wants to pay exorbitant taxes on anything, but there is one universal incentive mechanism which is guaranteed to make politicians consider your request: $$$$$$$$$.
So "tax the shite out of it" is nothing more than shorthand for "look a-hole, make it legal and we will pay more taxes for you to piss away on graft and pork".

1. we are way over-regulated on the criminal end
2. we have a larger lower class population than the rest of the developed world and this creates conflict via a high Gini Coefficient
there's lots of parasitic behaviors involved in 1 and 2. over-regulation kills economic potential which increases teh likelihood of crime. high crime (primarily of the 80s and 90s) led to a major increase in over-policing and over-regulation. and on and on
