The alternating fence, HOA Rule is bullshite. I would rather look at one uniform side, back or front instead of a mix of both.

I only read two pages and it seems to have been covered but FYI. I worked for a fence company in college and know of what I speak. In short, this guy saw you coming and lied to you. On top of that, he dropped off two minimum wage idiots who did a shite job. Don't pay a dime. Tell him to tear down his work and leave. Start over with a legit fence builder. Seriously, it is going to be as much work to fix this as to start from scratch and make sure someone digs up and removes the old posts. Be sure they backfill where they dig so it doesn't cause your new posts to lean into the hole. What a mess.

I agree, that broken-off post looks like crap. Just lazy, I would guess.
I would also have an issue with the alternating-panel design, but I understand dealing with an HOA as well.

I just went back to the OP and looked at your pics again...
There's no way I'd pay for that. The spacing on those cross boards is ridiculous. It really looks like he just eyeballed everything from up close... then stepped back at the end and said "frick it... that's close enough"

If alternating is HOA, just buy boards and cover your side for consistency. That is an easy Saturday job.

A quick breakdown of pine vs cedar
This is just a google link I found, but read this. It's a Houston fence company(I don't know this company) breaking down why cedar is a better choice for fence pickets. I just can't believe a fence guy would tell you pine was better.
If your paying several thousand dollars you should get a fence that last, not one that will warp.
How much did you pay per linear foot for a pine fence? The going rate for a cedar fence in Texas should be between $15 to $20 a foot.
Last thing, did they use screws on your pine fence. If not and they used nails then that fence will be badly warped in a few years.

I had my fence replaced this spring. I live in the Austin area and things are pretty expensive over here.
I payed $17 a foot for a cedar fence with pressure treated post. You should be able to get a similar deal in Houston. (It was either #1 or #2 grade, dont go below those grades of cedar. It will be full of knot holes if you do. Knot holes rot out and leave holes in the fence)
I dont know what you do now that he used pine, but i would ask for a deal to pull down the pine pickets and replace with cedar because he lied to you.
Eta- that 17 per foot is a total cost of materials and labor. No extra added on. My bill was x number of feet times 17.
