I’m just curious, who is claiming she was raped?
She obviously can’t testify that she was raped
Are one of the guys that were in the car saying she was raped?
Just bc there’s evidence she had sex, but what’s the evidence pointing to rape?
I know these questions have been answered but I’m trying to catch up

It's this and if they do take the chance it testifying at trial you can't let them testify to something you know is false. So you don't ask specifics and therefore you cannot knowingly suborn perjury.
I've known of some attorneys who thought that they would always be able to tell their client not to testify a trial who got into a pickle and had to do the whole sidebar conference and basically tell everyone they know their clients about the lie and it causes all sorts of problems

this is something people need to remember when a rape victim doesn’t come forward right away.
This is how you defend rape charges and if Madison was alive shed have to address this in cross examination.
Rape is such a hard crime to prosecute.

A young, “pretty” white girl died who got drunk and had sex. The initial outrage was over false narratives based on who she had sex with. No witness claimed rape. No video we have seen suggests rape. The only thing the prosecution seems to be leaning on is some possible trauma related to sex. Because she is alleged to have had sex with another person less than 24 hours before this incident, there is likely no way to tell where the trauma originated. It doesn’t seem like there is much of a case.

I haven't looked at the indictment in a long time, but I believe they based the charges on whatever video exists, the physical injuries from her autopsy, and the initial statements of the guy whose attorney filed this motion. Perhaps also surveillance footage and testimony from the bar they were at about how much she had had to drink, etc.
There was also immense pressure to bring charges in BR at the time given the obvious impact of a young attractive LSU student being killed after leaving a popular college bar.
