Barreto says he had just moved to New York from Los Angeles when his boyfriend told him about a loophole that allows occupants of single rooms in buildings constructed before 1969 to demand a six-month lease. Barreto claimed that because he'd paid for a night in the hotel, he counted as a tenant.
He asked for a lease and the hotel promptly kicked him out.
“So I went to court the next day. The judge denied. I appealed to the (state) Supreme Court and I won the appeal," Barreto said, adding that at a crucial point in the case, lawyers for the building's owners didn't show up, allowing him to win by default.
The judge ordered the hotel to give Baretto a key. He said he lived there until July 2023 without paying any rent because the building's owners never wanted to negotiate a lease with him, but they couldn't kick him out.

The level of entitlement of people today. You’ve already fraudulently gotten yourself a rent free place to live for years. Not good enough. I’m going to claim ownership of the whole building and try to charge rent (which I refused to pay) to other tenants. DIAF

The New York Supreme Court is not the “Supreme Court.” It’s what they basically call their district court. There are 2 appellate levels above that (one is also called the Supreme Court). He probably doesn’t even know that. The owners should win this at the Court of Appeals (New York’s highest court).

My brother is an HPD officer. In a not so great part of SE Houston a landlord owns a bunch of homes. When he needs to get rid of someone he doesn't bother with the court system as it takes too long.
He sends a small crew over to the house and they remove the front and back doors. They have them rigged so they can just remove them. They load the doors up and just leave with the house wide open.
My brother said this is a highly effective technique in those neighborhoods.
