DUI is a requirement for vehicular homicide. Once they realized he wasn't the vehicular homicide suspect, his arrest becomes a normal DUI instead.
It sounds like he was driving drunk with his un-seatbelted child in the vehicle when they were investigating the hit and run so they pinned the vehicular homicide on him. Now that he's innocent of that charge, he's only charged with DUI and child endangerment + no child restraint.

You better hope like hell that there is visual evidence and witnesses to show that the kid darted out and it was an accident and not carelessness by the driver. That would be a terrible scenario for everyone. The driver, even if innocent, would always blame themselves forever (if they had a conscious.)

That will easily get thrown out. They went to wal mart to arrest him on a bogus charge. There was no probable cause for a DWI stop.

We will have to wait until blood samples come back. He blew 0.0 at the jail and then St Tammany’s “finest” wanted to say it was pills.

Possibly. I suspect the prosecutorial argument would be that during a lawful hit and run investigation they found what turned out to be an unrelated DUI. I believe the DUI arrest is perfectly lawful at that point per case law, but a weak DA may cave anyway.

The only certain charge is the driving on a suspended license.
There's a whole lot of gray area on the DUI and child endangerment/no child restraint charges.

RS addressed it in a statement. Why would he even say “if such a connection existed” if it’s 100% false? I think he sucks as a person so it wouldn’t surprise me if he is involved with her.

Based on everything said so far in the thread, I wouldn’t pursue charges if I were the St Tammany DA.
The absolute shite show of how STPSD handled this would complicate any trial and make it a waste of time and taxpayer dollars.
