§32.1. Vehicular homicide

A. Vehicular homicide is the killing of a human being caused proximately or caused directly by an offender engaged in the operation of, or in actual physical control of, any motor vehicle, aircraft, watercraft, or other means of conveyance, whether or not the offender had the intent to cause death or great bodily harm, whenever any of the following conditions exists and such condition was a contributing factor to the killing:

(1) The operator is under the influence of alcoholic beverages as determined by chemical tests administered under the provisions of R.S. 32:662.

(2) The operator's blood alcohol concentration is 0.08 percent or more by weight based upon grams of alcohol per one hundred cubic centimeters of blood.

(3) The operator is under the influence of any controlled dangerous substance listed in Schedule I, II, III, IV, or V as set forth in R.S. 40:964.

(4) The operator is under the influence of alcoholic beverages.

(5)(a) The operator is under the influence of a combination of alcohol and one or more drugs which are not controlled dangerous substances and which are legally obtainable with or without a prescription.

Looks like there's a crosswalk right fricking there too. Hate to be insensitive but if this pedestrian isn't too lazy to walk a few more feet, he's probably still alive. Sucks for all involved though, shitty situation.

So everyone speeding on Florida Blvd should be taken to jail? Should also depend on how much over the speed limit he was driving. If he was just doing 10 to 15 over and you think he should go to jail for Negligent homicide because someone who shouldn't have been in the roadway got hit then everyone who gets caught speeding should see jailtime for reckless driving

Well the dead guy was a POC* but so was the officer I believe. So it was a wash for the SJW's minus about .18 for the driver being a cop.

*I used what I believe to be the correct non-bannable terminology here for a Person of Color. Correct me if I erred.

Your post just proved you wrong. Vehicular homicide does not require the operator to be impaired.

You spelled toxicology report wrong.

For vehicular homicide, the driver MUST be under the influence in LA.

Honestly, with the amount of people that casually stroll across FL Blvd outside of crosswalks with zero concern for traffic, I'm surprised someone isn't killed everyday. If you're jaywalking across a busy street, I have zero sympathy for what happens to you.

I see this shite all the time at Perkins and Bluebonnet. Those dipshits play frogger in traffic when there is a crosswalk 50 ft away. Sometimes I hope they get hit.
