I handle claims for one of the big 3 insurance companies. I review police reports all the time involving pedestrians, and I can assure you it is very common for people to not be cited. Often times, the pedestrian is partially or fully responsible for themselves getting hit.

Also, fun fact, 75% or so cases I see are homeless people. I'm pulling that out of my arse, but it is a lot.

Sad, but the pedestrian was illegally crossing the street. That's why there are cross walks to begin with and times when crossing is appropriate. Still very sad. That cop will have to live with the fact he killed someone either way.

You can but you'd be wrong. Paid leave is while an investigation is pending. Suspension without pay is usually part of the punishment once violation of policy and procedure has been confirmed

Another false assumption. If the dept is listed as a defendant in the suit, they payment will come from the insurance company

As for the officer. If he is named in the suit, the department (union) may feed him to the wolves. It's been determined that he acted as his own by the fact that he was disciplined by not abiding by department policy and procedure. It relieves some of, if not all, the departments obligation of defending the officer in a civil trial

I think we all agree with this statement. And no one wishes blame on the LEO. However, this situation highlights the problems society has with LE in general. If Joe Citizen was speeding and hit a pedestrian, even one jaywalking, then the responding LEOs wouldn't give Joe Citizen the compassionate side, they would charge him.
