Like I said, I don't really consider it overly political, but at least somewhat so. But my point is if the school bans anything remotely political then this could fall into that.

Wellll, not really. If you read the whole story, he had multiple patches on his bag, including ones of "semi-automatic weapons", who knows what the hell that means these days. So it was the weapons patches that they were pissed about, not the flag patch, which seems to have been lumped into it.

I think it's all BS, but it seems like the flag patch was not the issue.

I have told associates more than once to avoid holding Tinker as settled law. First, you must view it through the lens of Morse v Frederick, and above all if you are thinking about bringing a student 1st Amendment action you REALLY need to read Justice Thomas' concurring opinion in Morse. Justice Thomas states that the right to free speech does not apply to students and he wants to see Tinker overturned altogether. If you wind up doing orals in front of SCOTUS using Tinker as your primary law you better get ready for the normally quiet one to open both barrels on you. A Tinker based claim would be ripe for a cert petition and a 1A absolutist should likely try to avoid it.

The Gadsden Flag is not a racist flag, symbol, whatever. I have it tattooed around my elbow. I'm not arguing with anyone who has already made this point. But 90% chance they stuck it on their kid's backpack because they knew it would illicit a reaction based on today's cultural climate. They knew they could get their 15 minutes of fame and here you all are, praising this kid like he's Crispus Attucks

Orrrrrr maybe the kid comes from a military family that values patriotism and passed those values on to their children. After all, this story takes place in Colorado Springs where the US Air Force Academy and Ft Carson are located.
