We should probably now realize that the National Football League is an entertainment enterprise that provides the appearance of being a sport competition enterprise. This entertainment enterprise has sole rights to the broadcast or dissemination of any images of its product.

Because the NFL has sole rights to decide whether any images of its product may be broadcast or disseminated, the NFL indeed does have the right to prohibit any such broadcast or dissemination of any image of its product, and the NFL may choose to enforce that right in a court of law.

That way, they can indeed sue anybody who displays a prohibited image of their product. In this case, the prohibited image of their product is the alleged Defensive Pass Interference incident against Tommylee Lewis that occurred with 1:49 remaining in the 4th Quarter.

Yes. Showing the play on a newscast would fall under the fair use doctrine.

The NFL’s legal protections extend primarily into the area of rebroadcast of games and the use of logos and copyrighted images without their permission.

They cannot stop a legitimate news organization from showing a :15 second clip of a newsworthy event. Fox is not showing the clip because they are going along with the NFL’s very likely terse request not to do so. The NFL’s lawyers are probably trying to strong-arm the media using that policy as its argument. Fox is just saying “okay” because they don’t want to deal with the legal bullshite.

Any real journalist knows they can walk into a courtroom and win on this issue. The problem, however, is that news organizations a) don’t know their rights and laws very well and b) do whatever their ownership tells them to do.

Drew checked out of a run play because of the coverage he saw. If he throws a better ball there it’s probably a 1st down or maybe even a td.

No. I don't watch sports media very much, especially not now.

But, the Saints Owner, Front Office, coaches, players and Saints alumni had better fall into a straight line on giving the NFL what it wants in the form of silence WRT this matter. If the Saints want to continue to make the NFL look bad and continue to call into question the integrity of the NFL's product, the NFL will WILL punish the Saints with more penalties intended to cripple the Saints competitive abilities. The NFL did it once by suspending Payton for a year and taking 2nd round picks for two years in a row. The NFL will do it again.

The NFL has an animus against the Payton-coached Saints. That should be fairly clear by now.

NFL Films own all the video and audio and you must have expressed written consent to use the both. They say it every game on TV. They can give and take away the consent to use the video.

CSP was almost crying during the post game interview. He is a hell of an actor if he got paid off. I think the NFL has told the Saints to STFU or else. Mickey Loomis has been sounding like a loyal NFL servant.
