ETA:

In an escalation of a standoff over her firing in The Mandalorian, Gina Carano is suing Disney and Lucasfilm for discrimination and wrongful termination in a lawsuit that opens another front in the battlefield for influence over Hollywood that has drawn in corporate America.

Carano, in a complaint filed on Tuesday in California federal court, alleges she was fired for voicing right-wing opinions on social media and seeks a court order that would force Lucasfilm to recast her. Elon Musk, making good on a promise to foot the legal bill for users who claim they have been discriminated against due to their activity on his platform, is helping fund the suit through X.

According to the complaint, Disney and Lucasfilm harassed and defamed Carano for refusing to conform with their viewpoints on issues relating to Black Lives Matter, preferred pronouns and disproven claims of election interference. While she was allegedly fired for her cultural and religious beliefs, Carano argues that the entertainment giant turned a blind eye to her male costars, who allegedly made offensive and denigrating posts directed towards Republicans.

lol you were quicker than me. I'll delete my thread.

Here's a direct link to her Tweet.

I think this part is pretty earth-shattering:

quote:

A couple months ago @ElonMusk tweeted that if you had been fired from using the platform (X) for exercising your right to free speech, he would like to offer these people legal representation. Quite the noble offer, but never in my wildest dreams would I have thought anyone would take on my case against Lucasfilm/Disney. Still, I did respond back “I think I qualify” & thousands of people agreed--but I did not expect anything.

To my surprise, a few months ago I received an email from a lawyer who had been hired by X to look into my story & many others. Turns out after sending them as much information as I could gather these past few months, my now lawyers & X believe whole-heartedly in my case & are moving forward.

I would like to express my deepest gratitude & thank you to @ElonMusk & @X for giving me an opportunity to bring my case to light.

I mean I'm on her side and hate cancellation culture and punishing opinions....

But that's not how this works.

If she wants to be in a picture, she doesn't need a lawyer, she needs the Godfather... And hope the head of Disney owns a prized horse.

I think there is a line where its reasonable for entertainment companies to want to convey a certain image publicly and are within their bounds to fire someone because of that. Its clearly different than say a garage firing a mechanic who posted "problematic" stuff online. But it doesn't seem like her posts were particularly problematic at all in this case.. Disney just caved to the mob.

Yeah she didn't say anything inflammatory, especially when you look at some of the things other cast members were saying.

it's so irritating the way that Big Media tacks "disproven", "fraudulent", or "false" onto "claims of election interference" every single time it is mentioned in an article.

For context:

What she said:

quote:

“Jews were beaten in the streets, not by Nazi soldiers but by their neighbors…even by children. Because history is edited, most people today don’t realize that to get to the point where Nazi soldiers could easily round up thousands of Jews, the government first made their own neighbors hate them simply for being Jews. How is that any different from hating someone for their political views,” she wrote.

quote:

Another photo on Carano’s Instagram story featured a person with several masks covering their face and head with the caption: “Meanwhile in California.”

quote:

Both posts were scrubbed from the actress’ Instagram this afternoon, but others picked it up and reposted (see below). Other posts, including a quote saying “Expecting everyone you encounter to agree with every belief or view you hold is f*cking wild,” and one saying “Jeff Epstein didn’t kill himself,” remained.

How Disney defined it:

quote:

Gina Carano is not currently employed by Lucasfilm and there are no plans for her to be in the future. Nevertheless, her social media posts denigrating people based on their cultural and religious identities are abhorrent and unacceptable.”

Seems like the only case she might have is breach of contract. I thought this board was perfectly fine with the "at will" employment model? Either they owe her money for breach of contract or they have the right to fire her.

"At will" employment and "defamation of character" are not the same thing. Unfortunately, our country's defamation statutes are woefully inadequate, so she's playing the only cards she can.

OK, but it seems like a defamation complaint is not the same as an employment complaint. How is forcing Disney to recast her a remedy for a defamation complaint?

Haha. So true. A relative of mine got fired by the state of California for being perceived of as an a-hole by his coworkers. Same guy is always going on about how much he loves conservative politics and how lucky I am to live in a conservatie "right to work" state. Now dude is suing state of California for unlawful termination.

If Disney had just left it at terminating her contract they might have been fine. Their need to publicly virtue signal may come back to haunt them.

OK, this might be relevant:
quote:

The First Amendment Does Not Protect You Here

One thing that is clear is that employees told to refrain from political arguments at work can’t turn to the First Amendment’s guarantee of freedom of speech. Federal law does little to protect employees from being fired or disciplined for their political beliefs or activities. Some people mistakenly believe that their First Amendment free speech rights extend to the workplace.

However, for most employees, this is not the case. The First Amendment prohibits the government from infringing on free speech; it does not apply to private employers. So, unless you work for the government, the First Amendment does not limit your employer in any way. (And, even for government workers, First Amendment rights are not absolute in the workplace.)

Seems like a slippery slope.

For those that really like to watch the world burn, think it'd be pretty funny if someone asked Musk to fund a lawsuit because they got fired for tweeting out brazen pro-Nazi or pro-racism rhetoric.

Just to see if he would take them up on it.

She might have a gender discrimination angle as well. I forget the specifics, but apparently Pedro Pascal posted some Holocaust related tweets and Disney looked the other way.
