I can't tell for certain, which is why I said the exact movement of Stewart's car will determine what happens next. But I don't think you can rule out that possibility.
A good crime lab should be able to produce evidence saying exactly what happened.

The sudden burst of acceleration isn't going to help TS at all. You can hear all the cars decelerating and then right as he comes up to Ward you hear his engine rev.

For both sides of the argument.
Both are wrong here but Tony is more wrong. He is a world class champion car driver. Other drivers saw the kid and acted accordingly to avoid him, there is no possible way anyone can say Tony did not know exactly what he was doing based off of other drivers actions and Tonys driving accomplishments.
Plain and simple.

Forgive me for being an idiot on this subject(and plenty others too) but is there a rule about getting out of your car if it is still drivable? Or at all? I know they get out all the time but that doesn't mean it's a protected action. I'd think there has to be a rule like this simply to protect people from getting hit and the drivers from hitting them.

Couple of things:
They were under yellow so TS should have been slowing way Down
The accident was in a straightaway so why was stewart so high and not on the inside of the track avoiding the wreck?
Stewart had to be able to see him, he was coming out of a turn where the track opened up, so why didn't he steer away from him completely?
It looked like ward had stopped moving forward and was pointing at TS coming around, so why did TS pass so close to him?

Yes, but he knew there was a caution and where the wreck was, which means he should be careful in that area, no?
