How can you tell if stewart accelerated into the guy? I didn't see that in the video

I can't tell for certain, which is why I said the exact movement of Stewart's car will determine what happens next. But I don't think you can rule out that possibility.

A good crime lab should be able to produce evidence saying exactly what happened.

He knew where the wreck was, its not like it just jumped out at him out of nowhere

And he avoided the wreck, he didn't know this kid would walk into his path.

The sudden burst of acceleration isn't going to help TS at all. You can hear all the cars decelerating and then right as he comes up to Ward you hear his engine rev.

For both sides of the argument.

Both are wrong here but Tony is more wrong. He is a world class champion car driver. Other drivers saw the kid and acted accordingly to avoid him, there is no possible way anyone can say Tony did not know exactly what he was doing based off of other drivers actions and Tonys driving accomplishments.

Plain and simple.

Forgive me for being an idiot on this subject(and plenty others too) but is there a rule about getting out of your car if it is still drivable? Or at all? I know they get out all the time but that doesn't mean it's a protected action. I'd think there has to be a rule like this simply to protect people from getting hit and the drivers from hitting them.

Couple of things:
They were under yellow so TS should have been slowing way Down

The accident was in a straightaway so why was stewart so high and not on the inside of the track avoiding the wreck?

Stewart had to be able to see him, he was coming out of a turn where the track opened up, so why didn't he steer away from him completely?

It looked like ward had stopped moving forward and was pointing at TS coming around, so why did TS pass so close to him?

Good ol' Minden, LA. Never went there but have heard of it before. How long's it been since they shut that place down or is it still open?

Yes, but he knew there was a caution and where the wreck was, which means he should be careful in that area, no?

Seems like a professional driver should have had no problem avoiding it if he wanted to

Tony Stewart is a man
Young men run out in front of cars and get killed
Therefore, Tony Stewart is a murderer

trust me this is good logic

No - I used buzz by just as a saying - meaning TS clearly saw the kid giving him the shite about there bump and TS was taunting him back so to speak

You act like Stewart didn't see him until the last second. Everyone else seemed to move out of the way much earlier. You're telling me the best driver in the field was the only won to not see him?

Besides that frick up the rest of your post was perfect. Also, people seem to forget that TS had JUST run that dude off the road like 15 seconds earlier so TS knew DAMN WELL where the crash was, knew the driver was probably heated, knew the caution flag was out and yet he still gunned it and swerved when he saw the dude. No matter what the law says TS was at fault here and its not even debatable so any arguing is just a retard and I will leave it at that.
