there's no way he gets prosecuted criminally for this based on that video. Unless he confesses to intent, bc there's no way you can conclusively say he was trying hit the guy.

you don't need any intent for manslaughter or negligence, all about a reckless disregard for human life. an argument could be made that was pretty freaking reckless.

There were other cars passing on that same high line. The idiot ran way too close to the car. I hope he's alive, but to suggest that Stewart swerved into him is crazy.

So he's still alive? Is that confirmed?

What an idiot for getting out and walking into the middle of the track

My assessment

1. Kid should have stayed closer to his car if he was going to voice his displeasure.

2. Stewart should have been farther down the track.

3. It looks like Stewart might have possibly turned up towards him at the last second then gassed it because the kid looks to make a move to run away.

4. Stewart has been driving for forever, and he knew what would happen when he punched it. And he knew how close the kid was to his car. It was a heat of the moment thing but that is no excuse. Cooler heads must prevail in that situation.

I would be surprised if Stewart faces criminal charges based on the little we know/have seen.

I thought the white car almost hit the guy at first. Dumbass shouldn't have got out of his car and walk straight into the middle of the track where there's race cars flying by

And you can't tell any of tony Stewarts cars actions. Whether he swerved or accelerated or whatever. Camera is not on his car to tell if he swerves and the sound could come from any one of several cars on the track

I had an ex who raced dirt track. Getting out after a wreck and being confrontational is very common. No way Tony intentionally hit him.

In this type of racing wouldn't it be better to turn into a guy if you barely see him at the front right of your car? A sharp left turn would swing your rear tires into him wouldn't it?

From what I saw, my guess would be he tried to scare the guy though. Horrible all around.

Ward getting caught by the wheel caused the swerve.

Slowing down the video makes me believe this.

IMO, I think Smoke forgot what kind of vehicle he was driving and forgot he had exposed wheels.

I would tend to agree. I wouldn't want to be on his legal team for the civil suit.

He will get charged and have to take a plea, the evidence in that video alone is irrefutable. He won't get TOO fricked, legally, but he WILL have to take a plea and I would bet anyone anything on that.

This is true, the camera followed the car right before Tony and we don't really get a good look at what happens until there is already contact.

Oh, dear God...

NOBODY, and I mean NOBODY here is saying that he purposely swerved into him.

Not to speak for all of us, but for those that think Stewart royally fricked-up, it's because he chose not to drop down on the track when he saw the kid walking down the track then, when he passed the kid, he purposefully accelerated in an attempt to freak the kid out. Unfortunately, he did more than that.
