You said you saw it "many times". First, you don't watch NASCAR so I'm guessing you're referring to highlights. Second, there won't be hardly any highlights that are similar to the situation Ward put himself in. Sure, guys are on the track and yell. But we were talking about going after a car and becoming a moving target while it's moving toward you.

Only one I remember is quite a few years back when michael waltrip threw his helmet at robby gordon at new hampshire (or I may have the roles reversed). He got pretty close to his car then. Other than that they are usually 10 yards away

I am not a big race fan, but I don't recall seeing someone turn to the left where the back end gets sideways in the opposite way they are turning. Stewart is one of the best drivers in the world. Now all of a sudden we think he was just strolling along and didn't notice the guy walking to him because he's wearing black?

So the videos posted aren't proof that it happens? They aren't highlights? Every time someone does this it ends up on sportscenter

Yet again, Sprint Cars are different than stock cars. They are designed to drift, and are not designed for slow speeds like that. They do not react like stock cars, and visibility is much worse.

Guy's wearing black, at night, on a poorly lit track with low grip, Stewart is doing cool down lap speeds (which are elevated in sprint car), and has no way of knowing Ward had even exited his car, much less was literally hopping around in the track.
You can reiterate that Stewart is one of the best drivers in the world until you're blue in the face, but he's not omniscient.

It was said that it never happens by stout, only in WWE racing. Then it was proved that it does happen, so that argument changed to "well those aren't like this one". I have watched Nascar in the past. I don't watch it now. I have seen nascar highlights of this happening. Some of them have been posted.

I agree. It would be near impossible to prove anything based on that video. But if other evidence comes out, even if that evidence is Tony was just trying to scare the kid, I think a crime was committed.
I just do not agree with the blanket statement that if you are on the track, you are at fault every time. While that is generally true, intentional conduct by another counteracts that negligence.
to the extreme, if driver A runs onto a track, and driver B hits him, then backs up over him, then drives over him again, and says, "I wanted him dead." Welp, golly, driver A should not have been on the track, driver A's fault.

I'm not looking for an explanation from you. You seem to think this is black and white when there are obviously more variables. Im not trying to blindly back one side of an argument or another to win the internet. Keep doing your thing.
