Neither do privately recorded comments. We, and the media, have taken those comments and made a hostile work environment.
Let's be honest, the private comments of your boss that had no other impact on the working environment would fail miserably in an EEOC hostile work environment claim. Now arguably there is more than the recording comments, but for this comparison, that is irrelevant.
In the end, the NBA is making a business decision masked as a moral/ethical one. That is why the comparisons are apt. If the NBA wants to come clean and say "Well, a lot of fans and most players are black, and we can't make them play for a racist guy because it paints a bad visual" then I'd get on board with you.

If you replace black with Muslim in his rant, would be be banned?

we are basically just talking about the ensuing shite storm and the legality of what the nba is trying to do and whatnot. some idiots are being idiots, though.

What's the general consensus in here about the penalties?
Obviously they are WAY too strong, but are people on here just as fake outraged as the talking heads on TV are?

They do once they become public. Same thing would happen to your boss if he made such comments at home and the recordings were played for the entire office. You can't make the employees unhear it. Another reason FB bites ppl in the mass all the time.
I agree it's a business decision based on both liability and loss of sales.

nobody on tv is talking about the legal shitstorm brewing. are we overrating this or are they just gonna avoid it until it happens?

Step 4: Expelling Sterling from the NBA and defending a possible lawsuit by Sterling It is well known that some league officials and owners would like to see Sterling leave the NBA. Sterling has faced accusations of racism for years, including having to defend a housing lawsuit brought by the Department of Justice. The NBA also knows that wealthy NBA fans like Steve Ballmer and Chris Hansen—who sought to buy the Kings and relocate them to Seattle—would jump at the first chance to own an NBA team. Forcibly removing Sterling from the NBA is unlikely to happen.
The NBA's constitution, which is confidential, reportedly contains language permitting owners to authorize the league to sell a team without an owner's consent. The language, SI.com is told, only covers very limited circumstances and these circumstances concern team finances -- namely, when an owner can't pay his bills.
There is reportedly no language authorizing the NBA to sell a team because of an owner's hurtful remarks or embarrassing behavior. Even if constitutional language could be construed to authorize a forced sale of the Clippers, NBA owners would likely be reluctant to do so given the precedent it would set.
If what is bolded is stated in the NBA's constitution, Sterling won't win a lawsuit if it's he decides to take this to court. That statement is cut and dry to me and has been bargained and the courts will rule that way.

Some people are crying it's unAmerican.
Some people are saying the penalties are too harsh.
Some are racebaiting and anybody who has a different opinion then them is racist.
One guy is saying Sterling being Jewish has something to do with it.
A lot of people are taking the approach of he's a scum bag, but this sets terrible presidence moving forward.

Is it just me or would the smarter play by Silver to suspend Sterling indefinitely pending an investigation. Seems like he's making this harder on himself and the league.
Posted on 4/29/14 at 2:07 pm to Pettifogger
We did it! We beat racism!

True. But at least he is making an argument to back his position.

I think they're going to avoid it for now, if only so they can crow about getting his scalp.
People hate Sterling, so they can take a victory lap in his ban for now, then come back much later and talk about the legal problems to come.
