You are exactly right. And nobody knows that better than Kelly’s lawyers. So why are they saying they’re going to pursue legal action when they know as well as anyone they won’t and can’t? It’s a negotiating tactic. They are seeking a settlement. They are saying “We want a settlement at $42 million.” It is going to settle in the high $30 millions before the end of the year and he is going to get another job at some unfortunate place.

I legit despise Brian Kelly. Was probably my least favorite head coach ever even before he came to LSU and that opinion hasn't changed. But he 100% should get his money. I don't blame him one bit.

The contract requires him to look for work, but good luck enforcing it. Let’s say he doesn’t want to work. All he really has to do is have his agent float his name to a couple of teams in November each year, make a halfass attempt to show interest in a job, then either bomb the interview or ask for more money than they would realistically offer.
If he doesn’t want to work, there’s plenty of opportunity for him to do the bare minimum and keep collecting his paycheck.

Correct. The only thing going on here is negotiating the up-front lump sum.
LSU has no problem and won’t blink an eye to keep paying the $800k/mo til 2031. It’s just a matter of how bad Kelly wants a lower lump sum now and if he has any intentions of coaching again (or doing TV) to double-dip.
LSU has no incentive or reason to settle for anything over $30-$35mil or so lump sum now. The only good thing LSU did in his contract -and it was a very smart thing- was the payment structure of the buyout and not including any large lump-sum payments. LSU has all the leverage in the lump-sum now negotiations…. Because Kelly now wants something (up-front lump sum) that isn’t a part of the contract and LSU is under no obligation to provide.
If Kelly wants the cash now and the ability to work somewhere else and earn more, here’s your $30m…Take it or leave it. If you don’t accept that, then you’ll get your $800k/mo per the contract. Pretty simple.
Anyone asserting that “LSU is trying to not pay Kelly” simply doesn’t know how this stuff works regarding NPV and lump sum now or periodic payments. If Kelly wants the lump sum now, he’s gonna have to give LSU a “discount” on the NPV.

He is being an arse for wanting what's in his contract? I understand both sides and LSU has to see if he would accept less, that's just business, but if you sign me to a contract, you better be able to pay every cent the contract says I am owed. If they don't that could end up costing LSU more in the long run if BK decides to sue.

Then he'd be setting himself up for a huge lawsuit for violating the terms of his contract. LSU would certainly be willing to pay the legal costs of that fight in order to avoid the costs of the buyout.

frick Kelly and Woodward. Tell Kelly to pack his shite up, get in his private jet and come back to Louisiana. If we are paying him, have him and woodward shine all the helmets, wash the uniforms, clean the footballs, organize the folders, paint the fields. They can do it together.

Then he's a looser. I'm happy that I haven't hired any terrible people who suck at their jobs and overpaid them. I'd lose my business. He should be embarrassed, I would be. Most people in the world have to excel to be compensated like bk was.

Where are you getting this? Because I have not seen a single source saying Kelly is the one pursuing a lump sum payout. Everything I’ve seen (including the article linked in OP) says that it’s LSU pursuing the lump sum in an effort to reduce the buyout amount.

The BOTH want a lump sum because it's beneficial for both of them. It highly unlikely Kelly ever sees 100% of that money in any situation.
It's unlikely Kelly never wants to coach again. If he is a head coach again he won't get close to getting the whole 54 million. Every dollar he makes reduces the 54 million by that much. Even a head coaching job where he makes 4 million a year takes 20-30 million off the amount.
If he tries to retire...LSU will sue him for lower amount.
Kelly is trying to get more than 30 million he has been offered. My guess is he didn't like the pay schedule of it...the report said it was offered in 2 installments. He probably wants all of it now.
