No it's not. If anything it means he won't get a penny because it'll stay locked up in the state fiscal system for the next decade.

The Judge/court is not going to dictate the $ must come from Louisiana taxpayers. This is also just going to ensure this gets settled most likely with NDAs.

There is no mechanism to require the state of Louisiana to pay any judgement against them. The legislature would have to vote to appropriate the money but they aren’t required to vote yes. So the judgement sits in limbo until it can get out before a vote and pass. New Orleans is the same way.

Go look at the backlog of lawsuit payouts the State of Louisiana still owes. Go look at the backlog of lawsuit payouts the city of New Orleans still owes. Even if he wins it would be a long long time before he would get out - if ever.

The lawsuit as many people have said here again and again is all posturing for a settlement. He’s looking for a judgement that LSU did not fire him with cause so that he has more leverage.

So we think BK cares about this anymore? It’s obvious he’s done coaching and wants the biggest parachute possible. He doesn’t care about legacy or reputation. He want the cash. He’s a shitty human who took advantage of an athletic department who foolishly saw potential in him.

I heard the State of Louisiana owes around $300M in lawsuits. He will have to get in line and never get paid. I get that it is negotiations but why sue the state?

When you sue the state, if the settlement is more than 500k it needs legislative approval IIRC.

By filing a lawsuit against the State of Louisiana, the buyout, should CBK win, will be paid with taxpayer money, not booster money. LSU has two options. They could decide to fight this lawsuit, which will cost the taxpayers a lot of money, and run the risk of losing and it becoming a PR nightmare for LSU. Or they could go with the second option and renegotiate a buyout at a dollar amount both parties can agree on, which will avoid using taxpayer money and will allow both parties to move on. The longer this circus carries on, the worse it looks for LSU.


How many lawsuits have you ever heard of vs State of LA. have actually been paid even though the plaintive won!!!!! $0 would be my guess!

This whole concept of suing the state is dumb, and apparently came from something dumb that Moscona said.

Kelly is suing the Board of Supervisors. His contract is with the Board of Supervisors. Yes, it’s a state entity, but that’s not why he’s suing them.

The stuff about Louisiana’s $300 million backlog of lawsuit judgements is also dumb. Kelly isn’t suing for monetary damages. He’s suing to force LSU to acknowledge he was fired without cause. If he wins, it won’t be a $53 million judgement. It’ll be a statement saying he was fired without cause. At that point the contract takes over again.

If LSU were to still refuse to pay his buyout at that point, he could sue them again for breach of contract to force payment. But we’re nowhere near that, and I’d be shocked if it came to that. LSU isn’t going to straight up refuse to pay him without any contractual justification.

BOS and State of Louisiana are one and the same, see above. If he gets a judgement it will not be paid until the Louisiana Legislature passes an appropriation bill. There is currently 100s of millions of unpaid judgements
