The test in a negligence tort case would be the "but for" rule. But For Lacy illegally crossing the center line while exceeding the speed limit, there would have been no accident. To hang it all on evasive action by bailing out left vs right could pin a small amount / share of liability upon the KIA Cadenza driver. Rest assured the Cadenza driver will never have criminal charges brought against him.
