The test in a negligence tort case would be the "but for" rule. But For Lacy illegally crossing the center line while exceeding the speed limit, there would have been no accident. To hang it all on evasive action by bailing out left vs right could pin a small amount / share of liability upon the KIA Cadenza driver. Rest assured the Cadenza driver will never have criminal charges brought against him.

Right now the only source for that “fact” is you.

I guess if the first truck had just plowed into Lacy head-on instead of swerving, we wouldn’t have to argue about who was at fault. I wonder if the Kia drivers would have stopped and called 911 or drove away because they weren’t involved.
