At some point the people in charge of making the decisions at LSU have to weigh the potential PR cost of going down this path as well.
You're actively looking for a new head coach. Dragging your previous coach's name and reputation through the mud in a highly publicized manner - simply because you don't want to pay the full buyout you agreed to in his contract - would severely weaken your own chances at hiring a quality coach and tarnish LSU's reputation as well

The next coach also knows that LSU thinks any contract terms are subject to relitigation if it doesn’t work out. Basically, all terms in the contract have to be looked at with suspicion.

The suit is for a declaratory judgment that he was fired without cause. The only "dirt" LSU could possible put in their answer was his formal reprimands and that he didn't cure them within the allotted 7 days. If those don't exists, which no one has any reason to believe they do given the words and actions of everyone involved over the last few weeks, then BK will get his judgment. If there was some 10-D chess being played and LSU actually followed the procedure to fire him for cause, you will see the dirty laundry come out in the next suit where BK alleges the cause didn't exist.
ETA: This is a boring IRL procedural filing, not every court filing is an episode of Law and Order.

so scone said he's actually suing the state and not lsu. and the state has 300 million in unpaid lawsuits, so kelly would probably not end up collecting anyting.

We're all on TD throwing things against the wall and seeing what sticks. The reality is we don't have much info. We are all just barking dogs.

Disagree here. BK was just fired (or maybe not) from one of the best head coaching positions in college. BK left such a job as well when he came to LSU. He’s no different than you or I when looking for a new job. The job must meet his own criteria (not LSU’s) including salary, prestige, and so on. There are very few jobs that will meet what he considers a comparable position. His contract only says he needs to “exercise due diligence and use good faith” in seeking employment. That’s weak language. Nowhere is he required to apply for a position. He just needs to investigate the job market. Unless he has some burning desire to coach again, he’ll ride that $54m out until the end of his contract.
I doubt any media outlet would hire him either. His persona is not great.

You all are doing exactly what Kelly’s attorney wants, create outrage in public opinion to get the most for his client.
I think we saw this recently where one attorney posted a video of a car. Outrage pursued, then a second video emerged and just about everyone STFU.

He's getting a fat check, they will settle. LSU ain't getting out of paying him. They are wasting tax dollars paying shite head attorneys to blow smoke up people's asses.
Hell ksu attorneys probably already gave kelly a number they are close on. And this is the song and dance they agreed lau can do before the settlement.
A lot of shite is settled long before the court date. And one or both get to run their mouths before announcing a settlement
