If Lacy was in the incoming lane of traffic 2 seconds before the crash, then in my opinion he contributed to it in a significant way.

Lady’s black box car data shows her EBS didn’t activate and she was going 49 mph .5 seconds before she hit the other car. She was behind the gold truck. Wonder what the chances she was on her phone are and never even saw KL?

It appears there are a couple things that caused this accident (one of which was Lacy which resulted in the truck slowing down and braking), but after watching the video I’m gonna say the lady tailgating was by far the biggest factor in the wreck happening. If she’s not tailgating IMO this wreck never happens as she’s able to slow down and brake normally just as the truck did. Like you said, though… while probably not “criminal”, Lacy also played a part in this sequence of events.
Her following so close going near 50mph was/is a wreck waiting to happen, regardless what Lacy was doing.

You forgot the part where the witness statement of the truck driver was fabricated by the state police. All of which is on body cam, showing the state trooper trying to coerce a fabricated statement in response the witness specifically stated that he didnt slam on his brakes and the person behind him swerved to avoid hitting the back of him causing the wreck. The witness even refused to sign the fabricated witness report.

No, the black box data shows she was speeding and not paying attention never braking or swerving until 0.5 seconds prior to the impact.

These percentages of fault being referenced don’t apply to criminal cases. Civil/tort matters, yes. Criminal, no.

Going 28 mph. Vehicle 2 — that hit the car in which the driver died— had no attempt to stop her car per the video.
She was eating Funyuns listening to her music. Per the report.

Yeah I hope she has good coverage because I’m thinking she’s 70-80% if not more responsible for this wreck.
I’m no expert, but just on what I see if I had to place percentage blame:
-lady car tailgating 80%
-Lacy 15% (him passing all the cars is what caused the truck to slow down/brake)
-gold truck 5% (because slowing all the way down to 28mph was probably unnecessary)… I could go with 0% here because I’d much rather drivers be safe/slower than sorry, so I’m kinda torn on his braking actions

Yes exactly, he was 72 yards BEHIND the victim. Black box data shows he wasn’t speeding at the time of the wreck. The video clearly shows his car pulling up to the wreck AFTER the fact and then the cop is coercing the man who collided head on that did live into making a written statement blaming Kyren. The driver clearly told the cop that the lady BEHIND him caused the wreck worrying about Kyren.

What is illegal is following too closely. And crossing a center line. And having a tripper tell a witness about three if not four times to “not forget to write that you had to slam on your brakes” and the witness responded that he didn’t.
