What is the difference between cigs and the carcinogens put off by cooking over charcoal?

You mean around "your" food.

Of course, the only way that happens is if you CHOOSE to eat at a restaurant that allows it.

And, of course, a restaurant can only allow it if its OWNER chooses to allow it.

But, I guess you, as an INVITEE, should have greater rights to dictate the environment than the INVITOR/OWNER...

I agree with you, but this is one of those rare times that I'm happy the freedom stomping morons are getting their way.

this whole "im the owner i can do what i want" argument is worn out. if i own a machine shop i cant just dump whatever chemicals i want on my property. i can't say, "if you dont want to be exposed to these chemicals dont come to my place of business." no, the EPA regulates this for a reason.

Terrible analogy.
You willingly walk in to a smoking establishment fully understanding the supposed risk you inherit.

Dumping hazardous waste in to the ground/water can affect unknowing people as well as contaminate water or air to other unsuspecting people.

what if i own a restaurant and want to pump nitrous oxide in the air system. if you dont want to breathe NO2 dont come to my restaurant.

what if i own a fast food joint with a kids playground and i put dangerous sharp metal objects all over the place? if you dont want your kids to get hurt dont come to my place.

what if i own a brewery with beer made from human blood. if you dont want to ingest human blood, dont come to my brewery.

these are extreme examples but my point is that being a business owner doesnt give you the right to run your business to whatever extreme you want. (most) laws exists for a reason.

Your argument is still erroneous due to your use of hyperbole. Keep trying, though. Maybe you'll find a logical position sooner or later.
