I just don't agree with that because it is health related.
If you want to make some zany rule that everyone must wear a monocle and fubu jeans to get in your place, fine. But health related issues should be legally protected IMO.

I fully expect the N.O. city council to vote to ban all smoking in restaurants and bars going against many owners wishes. They are pretty anti-freedom.
I don't know why there needs to be an ordinance against smoking. Why not let the owners of said restaurants and bars choose whether or not smoking is allowed in their establishment? There is obviously a huge market for smoke free establishments.

Tennessee banned smoking from all restaurants except ones that are 21 & over.

According to the CDC, 2.5 million nonsmokers since 1964. So about 50,000 a year. That's too many.
