History buffs are gonna love the 2nd amendment trial

Can't link because it was America's 1st news Radio this morning.
There is gonna be a gun case before the USSC. Plaintiff vs. New York over the right to carry on the street. Seems NY (and 6 other states) won't give you a permit just because you want defense against a random act of violence.
Well, the plaintiffs are gonna prove the intent of the founders who wrote the 2nd by introducing English common law cases from the Middle Ages. The point being that the founders were ardent students of British law and much of the Bill of Rights stems from British cases.
I wonder what NY's response is going to be.

If they can successfully pull this off, could this mean the end of all permits for a firearm?
The Founders clearly never envisioned government controlled permits for firearms.

It means the standard for getting a permit will be 'I want one'. But the permits will still be necessary to avoid underage children and felons to get permits.
Another issue will be cost. If you have the right to carry a gun then the permits will be free. It's your right.

It was argued before the Court, this morning. Ended about 11:00 a.m.

Because the only people that carry are people with permits.

Will this apply to permits for suppressors and full auto?

I agree it should be free but thats totally not how it will work out.
you have the right to hunt and fish, etc., those need a license and are not free.

I did a paper on the 2A years ago. It was steeped in English law and precedent. This is a good thing in this case

The Bill of Rights (including the Second Amendment) was intended to constrain the actions of the central government, not those of the States or their subsidiaries. The Incorporation Doctrine is a cancer upon the Constitution.

But it's not in the Constitution. The right to drive a car is not in the Constitution so you have to pay for your license.

What are the other five states?
I know that NY is notorious for not wanting to hand out licenses unless someone is politically connected.
Less sure about the others. NJ? CT? MA? DE? MD?

I've always thought they had an angle in places like NY by going after unequal protection under the law. You can get a permit, you just have to be rich and/or connected. But I'm an engineer and I like logic, which frequently has no place in the courtroom.

Driving a car is a privilege, not a right. frick up too many times on the road and the privilege can be taken away from you. Same with voting… you become a felon and the privilege to vote is taken away.

Fine, then the same applies to hunting and fishing. You don't have a right guaranteed in the Constitution to practice either one.

That the Brits evolved and eventually banned guns and America should too would be my guess.
