I am in the medical field, he is receiving care from a licensed doctor in the nursing home. There is no way Medicaid is paying for nursing home care without a Physician coordinating his care. You can bet that a neurologist has been consulted no matter what the mother or the “friend said. This is very sad situation, the little bit of money that was raised will never be close to what he requires.

Maybe you can shed some light on the state of LA. I haven't read the pleadings and don't even know the specific COA or even the defendant (though I can guess) unless there are statutory limits to recovery isn't the case worth more with him alive than dead? Given the state he is in and likely prognosis you have basically all of the actuals of a death along with lifetime medicals. I know the numbers on the board are a lot higher alive than dead in this scenario where I practice.

I haven’t read any of the pleadings either but life care plans usually add up to more than the generals for a death here too. Sounds like future wage loss would be minimal. $500k cap on generals against a political subdivision of the state.

I don’t think she knows that. I know the lawyer who filed the suit against the jail, but he subsequently withdrew when she got the euthanasia/ right to life folks involved.

I’ll stay away from commenting much more on something active in my backyard but this is one that has to have to local civil defense guys salivating.

But if he lives, there is the pesky element of having to use the monetary awards to actually pay for his 24/7 care as intended. If he dies, no responsibility besides a funeral, more time for vacations

This is straight from the evil monster. There is a Dr at the nursing home who sees Josh. He is not a specialist of someone in Joshs condition. Would you want your primary care Dr treating you or your loved one in this condition? He never seen a neurologist after leaving the hospital. Everything is based off of him being seen in 2018 but his condition changed and improved after being seen. He wasn't able to follow commands when he was in the hospital but about a month after leaving he started to. The money that was raised is enough for him to receive at least a couple months of treatment and there are thousands of people ready to provide more so he can have a chance.

Exactly. If he lives any money she gets is his money and has to be accounted for and used for him. If he dies she gets all the money to do what she wants with it

Thanks for the general insight. All I know about LA law is in law school when the prof said "in 49 states" we all knew what the 50th state was.

spouse supersedes parents as a medical proxy.

This is such a terrible principle and can be proven so with a simple thought experiment:

Try to count how many people you are confident are in loving trusting marriages and compare that to the number of people you are confident have at least one trustworthy loving parent.

Obviously the workaround is having a living will, but just by the numbers it’s clear the default hierarchy should put parents over spouse. Probably siblings too.

Eh idk you’re probably more likely to have that convo with a spouse than a parent. I feel like most spouses would be trustworthy enough to respect your wishes, or they could even defer the decision, it’s probably rare they would act vindictively. If so then it’s your own damn fault for fostering such a relationship and not leaving or making a living will.

Then there’s a chronicity kinda deal. Usually parents are dead before their offspring so that wouldn’t be super helpful unless the person is too young and likely won’t have a spouse or adult kids so it would be a parent.

Fwiw the order is legally appointed guardian ( in this case it’s the spouse she was appointed curator by a judge), the spouse, adult children, parent, adult siblings, grandparent/grandchild, friend.

Don’t know what said judge was thinking; her motives are so painfully obvious.

I guess I’m thinking as someone in my 20’s, but after a couple of multi-year relationships there’s no one I’d rather make these decisions than my mom.

Tell them to start him on Ritalin, aricept, and amantadine (all meds that can be given through peg tube). It’s worth a shot to see if anything happens. Probably more published evidence for these meds than HBO for brain injury.

It will have to wait until his mom gets guardianship. The black widow doesn't even want to give him food or water. She isn't going to get him something that might help

This was filmed the day before she thought Josh was coming home to starve to death.

Look obviously you are close this situation and Josh and I respect the emotions involved but you keep posting tik tok. videos of this woman who everybody agrees has questionable motives. She's wacked, he obviously had issues His mom doesn't appear to be a candidate for Sainthood
but that doesn't mean letting Josh pass over the rainbow bridge is not what is best for him and everyone else

again I'm just saying you may be too close to the situation see what you're sharing is not helping

His mom has done nothing wrong and is fighting to help him. There are thousands of people who agree with exactly what I am saying. It would e cruel to starve him to death and he deserves a chance to try treatment and therapy. Wouldn't the best solution be for him to communicate for himself what he wants?
