Recent LA Supreme Court Case just released on similar fact pattern.

Though I will say that our budding law students/junior partners (would be) spot on (hypothetically) with their second degree battery prognosis.

Criminal statutes vary significantly by state. That charge doesn’t exist in Louisiana.

In that case, the attorney significantly mitigated from jump and freely cooperated with the ODC. I'll be curious to see how this case proceeds in those respects.

So, this is 100% true, but unless one knows why, it reads like the most dickish, sarcastic response ever

For the uninitiated: if an attorney is suspended for one year or less, at the end of their suspension, they are automatically readmitted to the practice of law. If they are suspended for more than one year, they are not automatically readmitted and must reapply (no, they don't have to retake the Bar), and there isn't necessarily a guarantee of re-admittance (plus it's a pain in the arse). Because of that, there is a huge difference between a suspension of a year and a suspension of a year and a day.
