Maybe a larger tract with the sewer line that was resubdivided later? Should have an easement or servitude. Need latest survey.
yeah, I can see that, I used to be pretty up on LA real estate law, not anymore, but it used to be that if the original property had historical access to wherever OP is tying into, it couldn't be denied by a newer property owner, as far as maintenance of the line, OP needs to stop being a little bitch and fix this mess, might consider an alternate route or burying the line deeper and putting in a small lift station

Older house built 30 years ago, line ran with access to their property. I'd have to look at that old agreement. If any, could have been simple verbal since it was family back then.
In the country, no subdivision.
this helps define the issue.
need to go to the court house and see the plot map for the neighbors property to see if there were servitude/utility right of way rights
if granted, approach the neighbor, with papers backing you up and ask for repair

sounds like you are shite out of luck. Just fix it.

quote:If it has been in place for 30+ years and not contested you have a prescriptive right to the line as it sits. As stated earlier, you should keep your head down and make the necessary repairs. Would be best to rework it to the degree where tractors and other equipment can't damage it in the future.

The only way they would be responsible is if there is an easement type agreement. Otherwise, you should have your line corrected to connect on your side.
This.

This is the correct answer and there are, as usual for the OT, a whole bunch of people talking out their arse in this thread. I know because this is the case with my house and the lawyers hashed this out for me previously.

Is it in an easement or something? Your utilities shouldn’t be tied in through adjacent property
Posted on 12/3/19 at 9:44 am to Taurus
So the sewage is spilling onto their property?
Looks like they have a problem.
Looks like they have a problem.

Did the neighbors themselves tear it up or did they hire someone that tore it up?
Further, isn’t there a law that you must have your yard marked by the utility companies before you dig up anything?
Isn’t water and sewer part of the utility group required to mark?

its concerning when you read the replies on a thread topic in which you have actual knowledge of. HVAC threads are 85% repeating rumors they heard from someone else.

I especially like the insurance threads. So many “experts” on the OT.

You can stop here. Your shite runs on their property, literally. They could drive a tank on it and it’s your problem. I’d be more upset if I were them. Just fix it.
I was always taught if you tear up someone's property. You repair or replace it.
It's called morals and ethics. You did the damage. Except responsibility for your incompetent stupidity.

Are you hooked up to a sewer system or your own septic system?
