Five men in Spain cleared of rape because 14 year old victim didn't fight back

People in Spain have expressed outrage after a court cleared five men of rape, ruling they did not use violence against their 14-year-old victim.

The court in Barcelona said the girl was drunk and unconscious at the time and did not fight back.

Instead the men were guilty of a lesser charge of sexual abuse because they did not use violence or intimidation, and their act could not be considered sexual assault.

They were sentenced to 10-12 years in jail and fined €12,000 (£10,300).




Pretty sick but then again she did wake up to two Angels and a Jesus so she has that to look forward to for the rest of her life.

i was one of the more conservative people in my law school class, but i felt like i was the only person driven absolutely nuts by the "resist to the utmost" standard for aggravated rape. we tell women that unless they are truly trained to defend themselves and feel confident that they can prevail, to NOT resist. And then we let rapists out of the aggravated rap when they don't. Blows my mind.

Real talk.

My daughter goes through that, I’m holding my own court.

That’s not just talk and i know it causes me to go to prison but that’s what I’m willing to go through if you put my baby through that

Sounds like a legal definition issue where an unconscious victim is neither forced or intimidated into compliance. If the facts didn’t meet the legal standard for rape, they should be demanding a change to the law.

lets be honest here, in america they would certainly be found guilty of rape and each one would get only 3-5 years in jail

so even though the legal reasoning denying it was rape is ludicrous, they got more then double the time in jail if the trial was in america
