Contractor invoice 1 year later

I had work done on my house over a year ago. I paid a deposit prior to the work being done and almost 1.5 years later received an invoice for the remainder. This is the first attempt to contact me in any form since completion. I sold the house “as-is” 2 months ago. I tried to pay the day they completed the work, but the workers didn’t have the capability to accept payment and said the PM would call me to get the payment. I don’t have the cash on hand to pay now, do I have to pay these guys?

What kind of work did you have done where the PM didn’t Invoice you for 1.5 years after? Did you ever think, I still need to pay these guys after the initial attempt?

Two choices:

1. Throw invoice in trash. It took then 18 months to invoice you, how long will it take them to follow up on non payment.

2. Call the guy, ask WTF? Then be honest and tell him you don’t have the cash and make an offer of a lower amount. Make sure he sends you a final invoice with the lower amount BEFORE you pay.

I kind of agree that a debt becomes dated at some point. You can’t sit around forever waiting on someone to ask to be paid.

You should pay them if they did the work properly. However, the contractor doesn’t have much recourse. If the home sale was done properly there is probablya title insurance policy and the current homeowner cannot be touched and I don’t think they can put a lien against that home. Probably small claims court vs you is about the only thing the contractor can do.

I would probably consider contacting contractor and working something out. Maybe a reduction or agree to split the amount into 4-6 payments. Honestly the contractor has some kind of problem with billing that needs to be fixed. The likelihood of getting paid decreases over time and everyone knows this.

I got a credit card in the mail. I maxed it out within a week. I didn't ask for the credit card but they sent me one anyways and I used it. Now they are sending me the bill. Do I have to pay?

Not only are you obligated to pay for the work you contracted for, but when the contractor places a lien on your old home, you can expect to be sued by your buyers.

I tried to pay upon completion of the work per the agreement we had. His employees would not accept the payment and said their boss would call me that week to settle up. He never did, no bill sent, no contact, nothing for 1.5 years, and I sold the house where the work was done a year later. So I am not going out of my way to make sure some asshat who can’t keep his finances in order (through an entire calendar year) gets paid. There was no lien on the house when I sold it. I no longer own the property.
