Yesterday a Trucker killed a motorcyclist in a crash on N. Eugene @ Florida Street. I had assumed it was an accident but reading WAFB report from later in the day, it seems it was on purpose. Shouldn't this be vehicular homicide or 2nd degree murder?

WAFB Reports 18-Wheeler Driver Charged with Negligent Homicide

quote:

“As the motorcycle passed the officers, the victim was observed yelling at the driver of the 18-wheeler,” states the report. “The 18-wheeler was then observed to strike the motorcycle in the rear several times. One of the witness officers yelled for them to pull over to the side of the road, but the 18-wheeler accelerated and struck the motorcycle in the rear again. This time, the victim was thrown from the motorcycle and was run over by every tire on the passenger side of the truck. The victim was immediately killed and pronounced dead at the scene.”

You can’t murder a motorcycle rider. They all have it coming in some way.

A good lawyer should be able to get him off.

All you say is that the thug motorcycle rider threatened his life by saying he was going to put a bomb on his gas tank.

Case dismissed.

The description and the negligence charge seem to be in conflict.

Still not as bad as the Alabama teabagger incident at Krystal Burger. Bama citizens are brave.

Why is this not 2nd degree murder or Manslaughter?

The ONLY way that makes sense is if the motorcyclist was foolishly brake-checking the trucker aka "daring the truck to hit him".

But the article doesn't mention that.

Well he says he never even saw the Motorcycle thought he ran over a pole or something. Much more likely than he intended to kill the guy--even if it was road rage.

It is generally not a wise decision for a motorcycle rider to start a road rage issue with someone driving a large commercial truck.

I’m going straight to hell. I’ve spent too much time on the OT. I chuckled a little when I read this
