Oh man, not this judge. He's had it out for me ever since I accidentally ran over his dog. Only replace accidentally with repeatedly..and dog with son.

That’s why I have an auto policy on my golf cart with the same limits I carry on our cars.

How?
HOA board members don't have legal authority to enforce state laws. Even if it's a gated community and the roads are private, how can the HOA board be responsible for the actions of association members?

I do not believe it was a hit and run. Yes it was a good sign the child started crying. Not sure of any updates. Scary situation.

I seriously doubt they could. Also, most HOA's carry some form of liability insurance to defend boardmembers against lawsuits.

What I meant is that if it's in the HOA bylaws that golf carts are acceptable on the subdivision roads and a kid uses one, gets hit and hurt/killed by a car, then the HOA officers can very well be named in a lawsuit against the HOA since golf carts are illegal on most roadways. Now, if the roadways inside the subdivision are privately owned and privately maintained, that would open up a loophole I would assume.

Only if each board member or officer is individually named as an insured on that liability policy.

The HOA for my neighborhood specifically prohibits golf carts, ATVs etc… on neighborhood streets. I think that’s probably standard in all HOA restrictions considering safety and liability concerns.
Additionally, the majority of associations are created by the developer and later turned over to the homeowners. Hence, the Board is limited on what actions it can take regarding restrictions/violations/penalties and cannot make amendments without approval of association members.

HOA cannot do anything related to streets unless it is a gated community with private streets. Otherwise HOA cannot approve of golf carts(or anthing for that matter) if they are not legal with Fed, state and/or local government.
I say all that to say, HOAs do not allow or disallow golf carts in any instance that I have seen. It isn't their right. They do not own streets. The law is what is followed.
So if someone says an HOA allows it then they most likely don't know what they are talking about unless it is a gated community with private streets.

The worst thing about being an HOA board member is the vast majority of complaints you get are about things the HOA cannot control.
"Hey someone is driving a golf cart on the street! Why does the HOA allow this?!"
"Why does the HOA allow my neighbor's dog to poop on my lawn."
"Why is the HOA allowing them to develop the land next to us?"
